The creation of the European Economic Area and near accession of the candidate Members (East European countries) has further increased the relevance of this law. This book describes EU social security law, beginning with the rules relevant to migrant workers. Coverage includes Regulations 1408/71 and 574/72 and the case law of the Court of Justice of the EC. The book analyses the contributions of these judgments to the developments of coordination law and to the realisation of the objective of free movement of workers. In this respect the relation of the Regulation and the EC Treaty, which is shown in for instance the Kohll and Decker judgments, is analysed. Special attention is paid to the Proposal for Simplification and Modernisation of Regulation 1408/71. A second main part of EU social security law is the law on equal treatment of men and women. The Court of Justice issued several main decisions, of which the Barber judgment is a wellknown example. Since then, the case law has been further developed and this book helps the reader to understand the present state of affairs. A separate chapter analyses the combat against social exclusion of the EU and the instruments developed for this purpose. Book excerpt: There was a time when it was clear what risks social security policy was meant to protect: unemployment, sickness, and occupational disability. For many decades, although true equity remained elusive, a focus on these 'external' risks seemed to be enough. It is to the credit of more recent policy that such previously 'hidden' but all-important matters as excluded minorities, inadequate income, and obstacles to personal development are now on the agenda. Yet, with the globalization of the economy, new and unprecedented risks proliferate, most of them being of the 'manufactured' kind that stem from technological and economic factors that are largely independent of time and place and that do not lend themselves easily to regulation. Social Security in Transition surveys and analyses the forces affecting social security policy today as understood by twenty-one, mainly European, authorities in the field. Although each author focuses on specific issues (such as poverty, migration, retirement schemes, access to health care), a consensus emerges that social security can no longer be viewed as a distinct theoretical entity, but that it must be considered in a broad context of social policy that encompasses employment, education, and health care. That the state will remain the last resort for the resolution of dangerous social disparities seems inevitable; yet some transnational standards of fairness (including concerted action for the prevention of and combating the worst evils, such as poverty and social exclusion of migrants) are crucial if we are to develop meaningful state and collective arrangements that will not only support all individuals as they take responsibilities in life, enhance their opportunities, and make meaningful choices , but also safeguard the necessary level of social cohesion in society. Social Security in Transition builds on papers that were originally presented at a June 2001 symposium in The Hague to mark the centenary of the Dutch Occupational Accidents Act 1901 and at the same time of Dutch social security. The symposium was an initiative of the Social Security 2001 Foundation, which was set up by a group of Dutch ministries, administrations and supervisory agencies, and social partners.

In 2013 this arrangement will be replaced by the Vitality Arrangement. How can the establishment of the idea of individual savings schemes in traditional collective social security law be explained? The Court established that Uber does not merely provide an app, but rather offers a full transport service. Without Uber there would be no market for non-professional drivers using their own vehicles. Moreover, the platform exercises a decisive influence over the conditions under which drivers provide their service. These rulings address the very core of several highly debated questions on the legal status of online intermediaries such as Uber, Airbnb and TaskRabbit. Is regulatory intervention needed to reap the potential benefits of the platform economy or to mitigate the potentially negative consequences of regulatory disruption? Can platforms be held liable for the proper execution of services provided by others? Does existing national regulation impose disproportionate market restrictions on innovators? Should we rethink labour protection aand social security to address the potential loss of social protection of non-standard workers? How can revenue law be improved to tackle elaborate (international) schemes to avoid direct and indirect taxation?
