Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.

The Committee's recommendations include: 1) that the Government state whether the British intelligence agencies have sufficient resources to protect the UK and facilities overseas from international terrorism, and provide a full statement on EU-wide co-operation and progress in counter-terrorism measures; 2) the need to consider whether the Geneva Conventions are appropriate in the light of modern warfare or if they should be amended to fully protect civilians and combatants in conflicts; 3) the Government should set out its policy on the use of nuclear, chemical and biological weapons; and 4) any actions taken against Iraq conforms with international law.

Book excerpt: In February 2002, as the general elections in Zimbabwe approached, the Committee published a short Report, placing on the record evidence received about the deteriorating political and economic situation in that country. This Report contains an analysis of the situation before and since the March 2002 elections, together with conclusions and recommendations. The Committee finds that since 1980 Robert Mugabe has deliberately and systematically flouted the rule of law in Zimbabwe, has lost the moral right to govern his people; and by abusing their fundamental rights and freedoms, he has earned their contempt and that of the international community, and has transformed himself from a respected statesman into an outcast. The report also deals with the response by the United Kingdom, the Commonwealth, European Union, United Nations and Zimbabwe's neighbours to the current crisis. The UK is under a particular obligation to assist, because as the former colonial power it still has a residual responsibility. Yet, because it is the former colonial power, the United Kingdom's actions are viewed with suspicion and mistrust: for the time being, it must therefore work with and through other countries and international agencies.
