An increasing number of middle class Americans do not have employer-provided insurance and—due to skyrocketing premiums—cannot afford to purchase coverage for themselves. Reinsuring Health, by economist Katherine Swartz, examines this growing national crisis and outlines a concrete plan to make health insurance accessible and affordable for all Americans. Reinsuring Health documents why the number of uninsured Americans—now 45.5 million people—has grown in the last twenty-five years. Swartz focuses on how labor market changes—such as the decline of domestic manufacturing, decreased unionization, and the growth of non-standard work arrangements—have led U.S. employers to retreat from providing health insurance for their workers. These trends, combined with the increasing costs of medical care, have led to an explosion in health insurance premiums and a decline in coverage, particularly among the middle-class. Since those who seek insurance as individuals are generally most likely to need health care, private insurers charge higher premiums in the individual (non-group) markets than to people who obtain group insurance. This makes individual health insurance less attractive to the young and increasingly unaffordable for middle-class Americans. Similarly, insurers charge higher per person (or per family) premiums to small firms than to large companies, so many small firms do not sponsor coverage for their employees. Reinsuring Health shows how these problems can be overcome if the federal government provides a new reinsurance program which would protect insurance companies that provide small group and individual health insurance against the possibility that their policy-holders will incur very high medical expenses. By assuming some of the risk that people will face extremely costly medical bills, the government will make insurers less hesitant to offer coverage to high-risk individuals, and will help drive down premiums for others. Reinsuring Health demonstrates that this form of government reinsurance has worked in the past, helping to establish smooth running private markets for catastrophe insurance and secondary mortgages. Today, growing numbers of middle class Americans lack health insurance. Protection against the possibility of falling ill or getting hurt and having to pay extraordinary health care bills should not be a luxury available only to the very rich and the very poor. Reinsuring Health proposes a straightforward solution that would bring health insurance back within the reach of the increasing ranks of the uninsured, particularly those who are in the middle class.

Today, fewer than one-third of small firms now offer health insurance and the number of people covered by small group insurance continues to drop. These problems invite the obvious question: What should be done about the small group market? Past scholarship on the small group market has largely focused on documenting the market's problems, evaluating the effectiveness of prior reform efforts, and proposing regulatory changes to stabilize the market. This Article takes a different approach to the small group problem by asking a previously unasked question: Does the small group market deliver group insurance benefits? Group insurance, first established in the life insurance industry, came about because it offered insureds a better deal than individual coverage. Group insurance provided four core benefits: reduced adverse selection, lower administrative costs, greater access to insurance, and tax-subsidized premiums. This Article argues the small group market largely fails to deliver the core benefits of group coverage. For many, the small group market offers no better deal than the individual market. Given these findings, it is hard to justify further interventions to save the small group market. The decline and dissolution of the small group market would likely shift millions to the individual market, resulting in a substantially larger and more stable individual market.

Book excerpt: This paper examines the percentage of employers offering health insurance from 2008-2015 to better understand how health insurance offer rates have been affected by the Affordable Care Act of 2010 (ACA), the Great Recession of 2007-2009, and the subsequent economic recovery. The data come from the Medical Expenditure Panel Survey-Insurance Component (MEPS-IC). Over 95 percent of employers with 100 or more employees offered health coverage before enactment of the ACA and continue to do so. More specifically, among employers with 1,000 or more employees, 98.9 percent offered health coverage in 2004 and 2005 and over 99 percent offered health coverage in each year from 2009 through 2015. Among employers with 100-999 employees, just over 94 percent offered health benefits in 2004-2006, while the percentages have ranged between 92.5 percent and 95.1 percent for 2012-2015. Offer rates among smaller employers have been falling since 2009: (a) for employers with fewer than 10 employees, from 35.6 percent in 2008 to 22.7 percent in 2015 (a 36 percent decrease), (b) for employers with 10-24 employees, from 66.1 percent in 2008 to 48.9 percent in 2015 (a 26 percent decline), and (c) for employers with 25-99 employees, from 81.3 percent in 2008 to 73.5 percent in 2015 (a 10 percent decline). There are several plausible reasons for the decline in health plan sponsorship among smaller employers, including rising health care costs; fear of rising health care costs; availability of non-group insurance in the public exchange; attitudes toward the ACA; the 2007-2009 recession; unemployment; and post-recession business and labor/employment softness and uncertainty. While health plan sponsorship hasn't declined among larger employers, some have predicted that even these employers -- traditionally more committed to sponsoring health coverage for their workers -- will begin to move away from sponsorship at some point in the future. There's no doubt that many larger employers have already made significant changes in the nature of their sponsorship, moving from defined benefit to defined contribution approaches that include more individual cost-sharing (both through employee premium or contributions and employee out-of-pocket expenses) and decision-making responsibilities; shifting to private health insurance exchanges; adopting wellness programs; and more generally supporting greater health consumer engagement.
