Book excerpt: Many believe that pirates and other water-bound terrorists present a significant threat to international maritime security. Testing the validity of this claim, Martin N. Murphy scrutinizes recent incidents of maritime terrorism and locates the commonalities between pirates and maritime terrorists that enable them to commit their extensive crimes. Murphy's research opens up surprising sites of contact between pirates and wider criminal networks, organizations that pursue their corrupt agendas not only on sea but also on land. It is these relationships, Murphy argues, that bring about the destabilization of states and regions in which piracy occurs. Murphy's most significant revelation is the way in which maritime criminality may disguise insurgent and terrorist activity, allowing such actors greater freedom to maneuver. Although these acts currently rank as a low-level threat, priacy feeds off of political upheaval. Before they can evolve into a truly powerful and dangerous force, however, maritime terrorists and insurgents will have to overcome significant operational and technical issues. They must also capture the attention of an international audience by committing atrocities at sea that are as devastating as those committed on land.

They have mounted what amounts to the most substantial non-state threat to the security of international shipping for half a century and perhaps longer. Piracy outbreaks have also occurred in Southeast Asia and West Africa. In each case the international community has responded differently. What lessons can be learned from three different approaches and is it possible to distill lessons of international best practice that can be applied in the Gulf of Aden and the northern Arabian Sea? This paper will examine how and why these three piracy outbreaks arose. It will describe in particular why the threat off Somalia grew so rapidly, why it declined and why the elements that made it successful remain in place. It will examine the responses of the international community, asking whether or not the response off Somalia might have been more effective if it had benefitted from stronger international backing and more coherent coordination. It will make the point that maritime security – the prevention and suppression of disorder at sea – must address many more issues than piracy as the theft of fish and the movement of drugs; weapons and people can often present greater risks. It will build on this point by looking at maritime security developments drawn from all three regions that may be employed advantageously in the Gulf of Aden and Arabian Sea, before circling back to look at the fundamental problem, which is one of landward security and asking what initiatives have been taken to address this in Somalia and which ones appear to be yielding results. Finally, it will examine whether the way forward does lie with a unified global initiative, or if steps are better taken regionally calling upon extra-regional support as necessary.

Yet even for terrorists and smugglers, the world is not flat; states exert formidable control over the technologies of globalization, and difficult terrain poses many of the same problems today as it has throughout human history. In No Man's Land, Justin V. Hastings examines the complex relationship that illicit groups have with modern technology—and how and when geography still matters. Based on often difficult fieldwork in Southeast Asia, Hastings traces the logistics networks, command and control structures, and training programs of three distinct clandestine organizations: the terrorist group Jemaah Islamiyah, the insurgent Free Aceh Movement, and organized criminals in the form of smugglers and maritime pirates. Hastings also compares the experiences of these groups to others outside Southeast Asia, including al-Qaeda, the Tamil Tigers, and the Somali pirates. Through reportage, memoirs, government archives, interrogation documents, and interviews with people on both sides of the law, he finds that despite their differences, these organizations are constrained and shaped by territory and technology in similar ways. In remote or hostile environments, where access to the infrastructure of globalization is limited, clandestine groups must set up their own costly alternatives. Even when successful, Hastings concludes, criminal, insurgent and terrorist organizations are not nearly as mobile as pessimistic views of the sinister side of globalization might suggest.

This book evaluates the extent to which the international maritime security measures developed following the 9/11 attacks would be likely to prevent the utilisation of vessels to facilitate terrorist activities. It considers the likely effectiveness of the International Ship and Port Facility Security Code for improving vessel and port security, and the 2005 Protocol to the Convention for the Suppression of Unlawful Acts Against Maritime Navigation in facilitating the interdiction of suspected terrorist vessels. It also explains how the US-led Proliferation Security Initiative - a cooperative effort through which participant governments agree to prevent the illicit transfers of Weapons of Mass Destruction and related materials – has provoked debate about the legality of vessel interdictions under the United Nations Convention on the Law of the Sea (the LOSC). After exploring alternative interpretations of the LOSC, and states’ self-defence rights under Article 51 of the Charter of the United Nations, it formulates suggested guidelines for the unilateral interdiction of suspected terrorist support vessels in exceptional circumstances. The book also discusses the relevant recommendations by the OECD’s Financial Action Taskforce for preventing the financing of terrorism, and the national maritime security legislation for preventing the maritime facilitation of terrorist activities in the United Kingdom and in Australia. The book concludes by emphasising the importance of the continual active implementation of ship, port facility and supply chain security measures, and of further enhancing international cooperation to facilitate vessel interdictions. Book excerpt: Maritime piracy's improbable re-emergence following the end of the Cold War was surprising as the image of pirates evokes masted galleons and cutlasses. Yet, the number of incidents and their intensity skyrocketed in the 1990s and 2000s off of the coasts of Indonesia, Malaysia, the Philippines, India, Bangladesh, Nigeria, and Somalia. As Ursula Daxecker and Brandon Prins demonstrate in Pirate Lands, Maritime piracy-like civil war, terrorism, and organized crime-is a problem of weak states. Surprisingly, though, pirates do not operate in the least governed areas of weak states. Daxecker and Prins address this puzzle by explaining why some coastal communities experience more pirate attacks in their vicinity than others. They find that pirates do well in places where elites and law enforcement can be bribed, but they also need access to functioning roads, ports, and markets. Using statistical analyses of cross-national and sub-national data on pirate attacks in Indonesia, Nigeria, and Somalia, Daxecker and Prins detail how governance at the state and local level explain the location of maritime piracy. Additionally, they employ geo-spatial tools to rigorously measure how local political capacity and infrastructure affect maritime piracy. Drawing upon interviews with former pirates, community members, and maritime security experts, Pirate Lands offers the first comprehensive, social-scientific account of a phenomenon whose re-appearance after centuries of remission took almost everyone by surprise.
