Book excerpt: Following on from a NAO report (HCP 798, session 2005-06, ISBN 0102936978) published in February 2006, the Committee's report concludes that the handling of cases in magistrates' courts has in recent years become complex and protracted to the extent that it no longer amounts to summary justice. 55 per cent of the £173 million cost of delay in the magistrates' courts is attributable to the defence, but the police and the Crown Prosecution Service (CPS) account for another 14 per cent (£24 million) each. The CPS needs to review its organisational structure, revise its system for preparing for magistrates' court cases by adopting current best practice, and address the cultural resistance within the organisation to more modern working practices.

Book excerpt: The prison population in England and Wales has been increasing since the 1990s and by November 2005 it reached a record level of 77,800, resulting in increased levels of overcrowding and stretched resources. Following on from a NAO report (HC 458, session 2005-06 (ISBN 0102935696) published in October 2005, the Committee's report examines how the Home Office, the Prison Service and the National Offender Management Service (which has responsibility for managing and accommodating prisoners) are dealing with the challenges involved in accommodating this record number of prisoners, the construction and use of temporary accommodation and the impact on the delivery of education and other training for prisoners. The Committee makes a number of conclusions and recommendations including in relation to: the deportation of foreign nationals, the use of alternatives to remand such as electronic tagging, contingency planning to ensure greater flexibility in accommodation plans including pilot testing new accommodation to identify possible problems early on, the application of best practice in anti-suicide monitoring measures, and the impact of moving prisoners around the prison estate on their training needs.

The Department recalculates each award annually and has identified that for 2003-04 it overpaid some £2.2 billion to 1.9 million families. It believes that 2004-05 will see a similar level of overpayment. This is partly due to the nature of the scheme where awards are provisionally based on previous income whilst the final award is based on actual income. However the level of overpayment has been higher than was initial estimated and repayments have caused distress to some families. This report looks at measures being taken to reduce overpayments; claimant error and fraud; and the settlement with EDS over problems with the computer system. The Committee attaches great importance to this subject and wish to return to it in the future.

Book excerpt: Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

Book excerpt: In many countries today there is a growing and genuinely-held concern that the institutional arrangements for the protection of human rights suffer from a 'democratic deficit'. Yet at the same time there appears to be a new consensus that human rights require legal protection and that all branches of the state have a shared responsibility for upholding and realising those legally protected rights. This volume of essays tries to understand this paradox by considering how parliaments have sought to discharge their responsibility to protect human rights. Contributors seek to take stock of the extent to which national and sub-national parliaments have developed legislative review for human rights compatibility, and the effect of international initiatives to increase the role of parliaments in relation to human rights. They also consider the relationship between legislative review and judicial review for human rights compatibility, and whether courts could do more to incentivise better democratic deliberation about human rights. Enhancing the role of parliaments in the protection and realisation of human rights emerges as an idea whose time has come, but the volume makes clear that there is a great deal more to do in all parliaments to develop the institutional structures, processes and mechanisms necessary to put human rights at the centre of their function of making law and holding the government to account. The sense of democratic deficit is unlikely to dissipate unless parliaments empower themselves by exercising the considerable powers and responsibilities they already have to interpret and apply human rights law, and courts in turn pay closer attention to that reasoned consideration. Book excerpt: Despite thirty years of equal pay legislation, the gender pay gap remains, although it is narrowing. It is hard to eliminate, because men and women tend to work in different occupations and traditional female occupations tend to be lower paid and lower valued than men's. But such occupational segregation limits the pool of recruits available to employers. In its 2005 report, the Women and Work Commission (http://www.womenandequalityunit.gov.uk/publications/women_work_5threp.pdf) made 40 recommendations to tackle job segregation and the gender pay gap and this report seeks to examine what action has been taken to implement those recommendations and to identify any further steps needed. The report finds: there are insufficient training opportunities for women in non-traditional occupations and, until recently, little advice available for older women who want to change their work direction or who return after a break; the announced extension in apprenticeships is welcome but must not just follow traditional occupational breakdowns; it is important to address the undervaluation of 'traditional' women's jobs; the dearth of quality part-time jobs is a waste of the experience and skills of many older women and one of the main reasons for the persistence of the gender pay gap. The extension to the private sector of the gender equality duty imposed on the public sector from April 2007 could encourage greater transparency and positive action, but it is too still early to judge the success of this duty. It is clearly the case that the gender pay gap remains worryingly stubborn. The Committee recommends that if the pay gap continues to decline only slowly, the Government should look at further measures such as the extension of the gender equality duty and consider making pay audits mandatory.

Book excerpt: This report responds to a complaint arising from a survey relating to local National Health Service (NHS) services in Mr Hunter's constituency of Cheadle and carried out by Mr Hunter and funded from his Communications Allowance (CA). There were three elements to the complaint: that the survey contained material that should not have been included in a CA funded survey; that it should not have been circulated outside the constituency; and that publicity for the survey in a newsletter funded and circulated by his local party in one part of his constituency amounted to exploitation of the survey for party political purposes. The Committee agree with the Parliamentary Commissioner for Standards that the survey included an incorrect imprint which suggested that it was party rather parliamentary in origin and that the CA should not have been used to distribute the survey outside Mr Hunter's constituency. They also agreed that, by themselves, the breaches were not so serious as to cause us to conclude that his survey should not have been funded from the CA
