As that backdrop recedes into the past, it is being replaced by a more multi-polar and confusing world, and the current state of the discipline of comparative constitutionalism reflects this fragmentation and uncertainty. This has opened up space for new, more varied, and increasingly critical voices seeking to improve the project of democratic constitutionalism. But it also raises questions: What of the past, if anything, is worth preserving? Which more recent parts should be defining of the field? In this context, this book asks which are - or should be - the canonical texts of comparative constitutionalism. The theoretical scope of the contributions is broad and ambitious, selecting primary material from beyond the existing textbooks to engage the concept of a canon. This framework provides significant insights about inclusion and exclusion, and proposes candidates for canonical and anti-canonical materials. The result is a wide-ranging discussion, among many voices, of how particular judgments and other primary texts have shaped or should shape our understanding of central elements of democratic constitutionalism from a comparative law perspective. As a knowledgeable professional, I encountered these problems when I was reading various law books, and it is one of the reasons that I was motivated to write this book. When I worked at the Norwalk Superior Court in Norwalk, California, under the supervision of Mr. Edward Hinz, I was privileged to become acquainted with the various judges, district attorneys, paralegals, clerks, legal secretaries, and officers. Although I realized that most were well acquainted with English legal terminology, I also observed that many people who came to court to represent themselves in propria persona didnt know or understand the correct legal terminology to be able to present their simple cases nor could they understand how to fill out the technical forms required. I am confident that this book will be a useful resource and that it can be easily used by all who want to become familiar with legal terms in English and Spanish. This book covers nine areas of law: alternative dispute resolutions, bankruptcy, business law, criminal law, family law, juvenile procedures, probate, real estate law/landlord and tenant, and wills and trusts. The terms are presented in English and Spanish. It is organized in such a manner that every term can be easily translated and understood. Each division contains the terms that are necessary for each area of law. Obviously, individuals who are already bilingual will have an advantage. Nevertheless, those who are not bilingual but who are interested in learning legal terms in Spanish or English, for one reason or another, will benefit from this book as well.

Book excerpt: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction.

Two main perspectives emerged: in some articles the topic relates to the conventional approach of law and/in humanities (iconography, literature, architecture, cinema, music), other articles are about more traditional connections between fields of knowledge (in particular, philosophy, political experiences, didactics).We decided not to confine authors to one particular methodological framework, preferring instead to promote historiographical openness. Our intention was to create a patchwork of different approaches, with each article drawing on a different area of culture to provide a new angle to the history being told. The variety of authorial nationalities gives the collection a multicultural character and the breadth of the chronological period it deals with from antiquity to the contemporary age adds further depth of insight.As the element that unites the collection is historiographical interpretation, we wanted to bring to the fore its historical depth. Thus for every chapter we organized the articles in chronological order according to the historical context covered.Looking at the final outcome, it was interesting to learn that more often than not the connection between law and humanities is not simply a relation between a specific branch of the law and a single field of the humanities, but rather a relation that could be developed in many directions at once, involving different fields of knowledge, and of arts and popular culture.We are grateful to Luigi Lacchè for his contribution to this collection.
