His doctrine of omnicompetent sovereignty had little influence on the thought and political debates of his time, for none of his writings was published until the last few years of his life; but it came under scrutiny later in the century, particularly during the exclusion crisis and in the political writings of John Locke. This book is the first comprehensive analysis of his thought, its context, and its place in English political thought as a whole. Daly examines Filmer's publishing career, his relation to contemporary writers and critics, and the chief sources on which he drew. The book thus provides the background for a study of Filmer's theory of sovereignty, its voluntarist concept of law, its rejection of prescription, fundamental law, and non-monarchical forms of government, and its insistence that monarchy be not only absolute, but arbitrary as well. Analysing Filmer's interpretation of Adam's (and all kings') 'fatherly power,' here described as 'legal patriarchalism,' Daly shows it to be very different from most contemporary thought. In comparing Filmer's thought with that of other royalists and the positions taken by his critics, notably Edward Gee, James Tyrrell, Algernon Sidney, and of course Locke, he shows it to be strikingly original, almost revolutionary, and frequently distorted by those who dealt with it.

Along with details of recorded history from the beginning to the death of the Apostles, the Bible also includes the laws that would govern history from that time to the end of the world. This central assumption was shared by nearly every member of Tory Christendom in England in the seventeenth century. In the same way, Filmer holds that it is impossible for a people to escape political anarchy once it is assumed that all individuals are independent and equal. It is also impossible for people to escape from collectivism, if it is granted that everyone has a moral right to an equal share of the gifts of nature. In explaining why Filmer remains both important and influential, Laslett argues that his reputation owes a great deal to the fortuitous circumstances of the time at which his works were resuscitated. His work passed almost unnoticed when it was first issued. Only the position of the Tory party gave his views prominence. The value of Patriarcha as a historical document consists primarily in its revelation of the strength and persistence in European culture of the patriarchal attitude to political problems. The opening essay by Laslett offers a brilliant analysis of late seventeenth-century English politics and philosophy. Long unavailable, this is a masterpiece of religious conservatism that still registers in debates at present.

At the time his treatises were written, English politics had undergone decades of upheaval in the wake of the English Civil War. When Dutch monarch William of Orange ascended to the English throne in the Glorious Revolution of 1688, burning questions over the best form of governance for England were prominent in the intelligentsia of the era. It was a time when England grappled with its incremental transition from monarchy to early forms of democracy and right to vote, where dynastic monarchy and religious theory still held considerable power over the formation of the state. In the first treatise Locke proceeds to attack and dissect his prominent contemporary Robert Filmer, who was broadly in favour of absolute monarchy under the principle of divine right. The allusions to the Biblical Adam, wherein the monarch can be intimated as a continuation of the first man ever created, are debunked by Locke who asserts that God never asserted that one man had province to rule over all other human beings. Supporting his argument with known history, Locke concludes that no king over the centuries had asserted to be the heir of Adam and thereby the rightful ruler of a country. Lauded as a classic of political philosophy, the treatises by Locke are a common requirement in various educational courses concerning political science and philosophy to this day. While steeped in the historical realities of the late 17th century, the arguments Locke composes for governance favourable to the people and their country's development were immensely influential on political theory during and after the Enlightenment era.

Two Treatises is more than a seminal work on the nature and legitimacy of government. It is also a masterclass in two key critical thinking skills: evaluation and reasoning. Evaluation is all about judging and assessing arguments – asking how relevant, adequate and convincing they are. And, at its heart, the first of Locke’s two treatises is pure evaluation: a long and incisive dissection of a treatise on the arguments in Sir Robert Filmer’s Patriarcha. Filmer’s book had defended the doctrine that kings were absolute rulers whose legitimacy came directly from God (the so-called “divine right of kings”), basing his arguments on Biblical explanations and evidence. Locke carefully rebutted Filmer’s arguments, on their own terms, by reference to both the Bible and to recorded history. Finding Filmer’s evidence either to be insufficient or unacceptable, Locke concluded that his argument for patriarchy was weak to the point of invalidity. In the second of Locke’s treatises, the author goes on to construct his own argument concerning the sources of legitimate power, and the nature of that power. Carefully building his own argument from a logical consideration of man in “the state of nature”, Locke creates a convincing argument that civilised society should be based on natural human rights and the social contract.

Gordon Schochet shows that patriarchal doctrines can be found in the writings of all major political theorists form Plato to Bodin and that almost every significant political thinker in the seventeenth century England acknowledged and addressed patriarchalism. In the Stuart period, patriarchalism was the primary alternative to social contract and populist justifications of political authority. Moreover, patriarchal power was a major presupposition of those very doctrines that were offered in opposition to it. The author demonstrates that the ideological, social structural, and philosophic roots of the patriarchal tradition are deeply embedded in the political consciousness and practices of Western Europe. In earlier political thought, familial doctrines provided anthropological accounts of the origins of political order, whereas in the Stuart period, patriarchalism was primarily a justification of political obligation. Analyzing these essential differences, Professor Schochet offers a number of sociological, and virtual disappearance of patriarchal conceptions of obligations during the seventeenth century. Untangling the patriarchal theory, he shows that it comported well with the implicit ideology and everyday life of the masses and was fully consistent with the level of historical awareness of the early modern period. The final chapter traces the ultimate demise of patriarchalism in the eighteenth century and its transformation back into a theory of political origins. In addition, the author discusses a number of important questions about the nature of political theory, how its historical documents may be analyzed, and the resort to symbols in political discourse.
