Book excerpt: In recent years, federal courts have become increasingly aggressive in shaping regulatory policy, abandoning their traditional deference to bureaucratic expertise. This new judicial activism has been particular evident in the regulation of air pollution. R. Shep Melnick analyzes the effects a variety of court decisions have had on federal air pollution control policy and assesses the courts’ institutional capacity for policymaking in such a complex arena. In six cases studies of environmental programs or issues he examines the interplay among the courts, the Environmental Protection Agency, Congress, and the White House. The conventional wisdom is that the courts have improved environmental policymaking, but Melnick concludes that as a whole "the consequences of court action under the Clean Air Act are neither random nor beneficial.” He finds that "court action has encouraged legislators and administrators to establish goals without considering how they canbe achieved,” widening the gap between promise and performance. The results, he charges, have been increased cynicism, serious inefficiencies and inequities, and a lack of rational debate. An analysis of the institutional characteristics of the judicial branch reveals how these problems have come about and why they are likely to afflict other programs as well as environmental regulation. The author proposes several reforms to improve the courts’ ability to handle regulatory cases.

Book excerpt: Water budgets—volumetric allotments of water to customers based on customer-specific characteristics and conservative resource standards—are an innovative means of improving water use efficiency. Once thought to be impractical because of technological constraints, water budgets linked with an increasing block rate structure have been implemented successfully in more than 20 utilities. As utilities develop advanced customer information systems and geographical information systems, these rate structures are expected to be applied more broadly. Water budget rate structures are attractive to water agencies searching for stable revenue generation, improved customer acceptance, increased water use efficiency, augmented affordability of nondiscretionary customer water consumption, and improved drought response. The objectives of this study were to examine water budgets and their potential value to North American water utilities and the varying applications of the water budget concept that have been adapted to different conditions. Key research issues included different practical approaches to water budget rate structures, the benefits and challenges of these approaches, the potential uses of water budgets during drought, and important steps in the water budget implementation process. An extensive literature review was conducted using bibliographic and web-based searches. The researchers conducted numerous structured interviews with water agencies that have already implemented water budgets and water agencies interested in the concept, but not yet using water budgets. This research focused on the technical ability and readiness of the agency as well as the potential barriers to implementation. Agencies also provided annual reports, consumption data, information on customer classes, and information on customer billing systems. Case studies on implemented water budget programs were developed by the research team and reviewed by agency personnel to ensure accuracy. Case studies were chosen to be illustrative of the successes and challenges involved in implementing a water budget rate structure.

Their penetrating look inside the National Highway Traffic Safety Administration (NHTSA) spans two decades and reveals the complexities of regulating risk in a free society. Hoping to stem the tide of rising automobile deaths and injuries, Congress passed the National Traffic and Motor Vehicle Safety Act in 1966. From that point on, automakers would build cars under the watchful eyes of the federal regulators at NHTSA. Curiously, however, the agency abandoned its safety mission of setting, monitoring, and enforcing performance standards in favor of the largely symbolic act of recalling defective autos. Mashaw and Harfst argue that the regulatory shift from rules to recalls was neither a response to a new vision of the public interest nor a result of pressure by the auto industry or other interest groups. Instead, the culprit was the legal environment surrounding NHTSA and other regulatory agencies such as the EPA, OSHA, and the Consumer Product Safety Commission. The authors show how NHTSA's decisions as well as its organization, processes, and personnel were reoriented in order to comply with the demands of a legal culture that proved surprisingly resistant to regulatory pressures. The new standards that they establish are usually too strict and costly to justify the benefits they confer. But, at the same time, the slow pace of standard-setting means that many serious hazards are never addressed at all. Mendeloff argues that more extensive, but less strict, rulemaking could make both industry and workers better off and that changes in legislation are required to break the current stalemate. Mendeloff looks at workplace risks regulated, and not regulated, by OSHA. He discusses the thorny issue of how much our society should value the prevention of occupational disease deaths. His innovative investigation of "underregulation" brings together diverse data to show that moderate reductions in current exposure levels would often be beneficial. Regulating Toxic Substancesmakes a major contribution to our understanding of how regulation works by demonstrating that the strictness with which standards are set is a major cause of the slow pace. Administrative rulemaking procedures offer opportunities for those concerned about the reasonableness of standards - judges and other public officials, as well as the affected industries - to try to block or delay them. An important implication is that less strict standards would not necessarily reduce overall protection and might increase it. In a major discussion of regulatory reform, Mendeloff analyzes such alternatives to standard-setting as information and liability strategies and such generic changes in regulatory procedures as regulatory budget and regulatory negotiation. Finding that neither provides a sufficient response to the overregulation-underregulation problem, he proposes a three-step legislative package that could be applied at OSHA and other standard-setting agencies. John Mendeloff is a policy analyst affiliated with the Program in Science, Technology, and Public Affairs at the University of California, San Diego.
