Available in PDF, EPUB and Kindle. Book excerpt: The collective volume “Modern Forms of Work. A European Comparative Study” evokes the intent to embody a reflection focused on modern labour law issues from a comparative perspective. A first set of essays contains national reports on modern forms of work. The second group contains some reflections regarding critical issues on digitalization, platforms and algorithms, analysing the different facets of the galaxy of digital work. The third group of essays flows into the section entitled “new balances and workers’ rights in the digital era”, a crucial topic in the debate. The complex of the writings, despite the diversity of approaches and methods, reveals the existence of a dense and inexhaustible dialogue between young scholars, at European and extra-European level. The analysis of new forms of work – the offspring of transnational processes of globalization and technologization – forms a fertile ground for experimenting a transnational dialogue on which young researchers can practice with excellent results, as this small volume confirms.

Book The Politics and Practice of Occupational Health and Safety Law Enforcement

Download or read book The Politics and Practice of Occupational Health and Safety Law Enforcement written by Diego Canciani and published by Springer. This book was released on 2018-10-04 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes a critical approach to examining British and Italian occupational health and safety enforcement policies and questions the legal and political principles that underpin them. The book undertakes a comparative critical analysis of these two jurisdictions’ health and safety regulatory enforcement practices by focusing on the causes and consequences of the under-criminalisation of these crimes. It explores the fundamentals of these two jurisdictions' criminal justice systems and political practices, policies and traditions and exposes how these translate into pragmatic social inequality and injustice for victims of occupational health and safety crimes and, more generally, citizens. Findings are drawn from qualitative interviews conducted with front line occupational health and safety enforcement officers. This book offers an account of the challenges encountered when attempting to scrutinise public institutions responsible for policing crimes of the powerful. The comparison of the political and criminal justice system practices, polices and traditions of the British and Italian legal systems offer a valuable critical contribution to the anglophone literature on the subject and, more generally, on regulatory enforcement policies and practices.

Book ERGOCHECK for a Preliminary Mapping of Risk at Work

Download or read book ERGOCHECK for a Preliminary Mapping of Risk at Work written by Daniela Colombini and published by CRC Press. This book was released on 2020-03-24 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the latest developments being pursued by the World Health Organization (WHO) and other international organizations (ILO, ISO), in relation to preventing work-related diseases and disorders, concerns the creation of "toolkits" and, within them, of simple tools. This book suggests a methodology and a comprehensive simple tool (ERGOCHECK, downloadable for free from the website www.epmresearch.org) for bringing together various potential risk factors to undertake a preliminary mapping of discomfort/danger in the workplaces and to assess consequent priorities for prevention, especially (but not only) in small and very small businesses. The tool is primarily designed to be used by employers, OSH (Occupational Health and Safety) operators and trade union representatives, but it may also be useful for occupational medical staff conducting periodical inspections and drafting health surveillance protocols, and for supervisory bodies (labor inspectors) conducting inspections in the workplace needing to rapidly detect potentially dangerous situations requiring specific preventive interventions. Daniela Colombini is a certified European ergonomist and a senior researcher at the Research Unit Ergonomics of Posture and Movement, Milan, where she developed methods for the analysis, evaluation and management of risk and damage from occupational biomechanical overload. She was a professor at the School of Specialization in Occupational Medicine in University of Milan and University of Florence. She is the coauthor of the OCRA method (EN 1005-5 standard and ISO 11228-3). She is the founder and president of the EPM International Ergonomics School (EPMIES). She has been working with accredited native teachers in countries such as the USA, France, India, Spain, Chile, Colombia, Guatemala, Costa Rica, Brazil and other South American countries. She is a member of the Ergonomics Committee of UNI working in the international commissions of European Committee for Normalization (CEN) and International Organization for Standardization (ISO). Enrico Occhipinti is a certified European ergonomist. He is a professor at the School of Specialization in Occupational Medicine in University of Milano, and the director of the Research Unit Ergonomics of Posture and Movement (EPM) at Fondazione Don Gnocchi ONLUS-Milano. He developed and coauthored the OCRA method. He is a member and has been a coordinator (up to 2012) of the Technical Committee on Prevention of Musculoskeletal Disorders of the International Ergonomics Association (IEA), and represents Italy in international commissions of the CEN and the ISO dealing with ergonomics and biomechanics.

Book Regulating the Collaborative Economy in the European Union Digital Single Market

Download or read book Regulating the Collaborative Economy in the European Union Digital Single Market written by Marco Inglese and published by Springer Nature. This book was released on 2019-11-11 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book critically assesses how the rise of the collaborative economy in the European Union Digital Single Market is disrupting consolidated legal acquisitions, such as classical internal market categories, as well as the applicability of consumer protection, data protection, and labour and competition law. It argues that the collaborative economy will, sooner or later, require some sort of regulatory intervention from the European Union. This regulatory intervention, far from stifling innovation, will benefit online platforms, service providers and users by providing them with a clearer and more predictable environment in which to conduct their business. Although primarily intended for academics, this book also appeals to a wider readership, including, but not limited to, national and international regulators, private firms and lobbies as well as online platforms, consumer associations and trade unions.

Book TUTTO81 il testo unico di salute e sicurezza sul lavoro

Download or read book TUTTO81 il testo unico di salute e sicurezza sul lavoro written by Talarico Giuseppe and published by EPC srl. This book was released on 2019-10-31 with total page 56 pages. Available in PDF, EPUB and Kindle. Book Fundamental Labour Rights and the Constitution

Download or read book Fundamental Labour Rights and the Constitution written by Giulia Frosecchi and published by Taylor & Francis. This book was released on 2023-07-05 with total page 150 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book reflects on constitutional balancing from the perspective of fundamental labour rights. It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. The book will be a valuable resource for academics and researchers working in the areas of labour law, social security law, legal theory and constitutional law.

Download or read book The Future of Work written by Adalberto Perulli and published by Kluwer Law International B.V.. This book was released on 2020-12-10 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: Studies in Employment and Social Policy Volume 56 Digitalization, far from being solely a technological issue, has broad implications in the social, labour, and economic spheres. It leads to dangers as well as to new chances for the workforce, and thus labour law must develop effective ways to both protect workers and allow them to profit from new technological developments. The most thorough book of its kind, this collection of expert essays provides an abundance of well-thought-out material for understanding the consequences of digitalization for the labour market and industrial relations. Recognizing that only an international perspective can make it possible to face the challenges of the present (and the future), renowned authorities from the International Labour Organization and the International Society for Labour and Social Security Law, as well as outstanding labour law professors, examine in depth such salient issues as the following: transformation of production systems; the spread of artificial intelligence; precariousness and exploitation in the gig economy; lessons learned from COVID-19; employment status of platform workers; new cross-border issues; rights to trade union association and collective bargaining; role of the State in the new digital labour market; and blurred lines between work and private life. Thanks to the international team of contributors, the issues are dealt with from a variety of overlapping perspectives and points of view, combining aspects of labour law, commercial law, corporate governance, and international law. Highlighting the need to adapt, especially through the right to training, work, and professionalism with respect to the new technological landscape, the book draws on legislative, judicial, and theoretical initiatives suggesting ways of responding positively to the requests for protection that arise in the new forms of production. A uniquely valuable tool for study and reflection for policymakers and academics, the book is also sure to be valued by entrepreneurs, managers, consultants, corporate lawyers, judges, human rights experts, and trade unionists who are interested in the issues of labour, industrial relations, and social rights in European and international contexts.
