Book excerpt: In 2003, elements of the U.S. shrimp industry became increasingly concerned by what they believed to be unfair pricing practices for warm-water shrimp exported by six countries: Brazil, China, Ecuador, India, Thailand, and Vietnam. An ad hoc committee of shrimp boat owners and shrimp processors filed antidumping petitions in late 2003. This action is opposed by U.S. seafood distributors, retailers, restaurateurs, and others involved in shrimp processing and marketing, as well as by the targeted exporting countries. Final determinations of antidumping duty investigations were announced by the Department of Commerce, and antidumping orders were issued in late January 2005. This report will be updated as the issue evolves.

Book excerpt: In its report "United States- Import Prohibition of Certain Shrimp and Shrimp Products,” the WTO Appellate Body attempts to foster a process whereby diverse interests are accounted for when regulations addressing environmental issues affect trans-border trade. In this way, the Appellate Body decision significantly departed from former GATT jurisprudence and, in particular, the former GATT panel decisions in the two tuna-dolphin cases of 1991 and 1994. The Appellate Body decision can be viewed as a response to challenges to WTO legitimacy by powerful constituencies in the United States and Europe which successfully pressured their governmental representatives to seek changes in the application of GATT rules. The shrimp-turtle case involved the application of GATT rules to a trade dispute over production and process methods (known as "ppms") for the trawling of shrimp, which kill endangered sea turtles. As in the earlier tuna-dolphin conflict, while the U.S. lost the legal case, the developing country complainants may be prompted to upgrade their environmental regulations. In the end, foreign shrimpers wishing to export shrimp to the U.S. market will likely be forced to use TEDs.

To a greater degree than any comparable treatment, this book focuses on the role of the WTO dispute settlement system in addressing trade-environment conflicts. Highlighting the ways in which environmental issues challenge the legitimacy of WTO jurisprudence, it considers such relevant core issues as the following: challenges posed to the WTO by so-called and"linkageand" issues, such as environmental protection, labour, and investment; to what extent the WTO can apply rules of international law (e.g., environmental ones) that are not contained in the WTO agreements; and concerns over the Dispute Settlement System's lack of democratic accountability in matters of great public interest.
