During economic downturns, American employers rely heavily on layoffs to cut their work force, much more than do their counterparts in other industrialized nations. The hardships imposed by these layoffs have led many to question whether the U.S. workers can be offered more secure employment without burdening the companies that employ them. In this book, Katharine Abraham and Susan Houseman address this question by comparing labor adjustment practices in the United States, whether existing policies arguably encourage layoffs, with those in Germany, a county with much stronger job protection for workers. From their assessment of the German experience, the authors recommend new public policies that promote alternatives to layoffs and help reduce unemployment. Beginning with an overview of the labor markets in Germany and the United States, Abraham and Houseman emphasize the interaction of various labor market policies. Stronger job security in Germany has been accomplished by an unemployment insurance system that deters layoffs. In the U.S., the unemployment insurance system has encouraged layoffs while discouraging the use of work-sharing schemes. The authors examine the effects of job security on the efficiency and equity of labor market adjustment and review trends in U.S. policy. Finally, the authors recommend reforms of the U.S. unemployment insurance system that include stronger experience rating and an expansion of short-term compensation programs. They also point to the critical link between job security and the system of worker training in Germany, and advocate policies that would encourage more training by U.S. companies.

But in recent years, and in spite of the adoption of the Charter of Fundamental Rights, the EU social profile has entered a profound period of crisis. The ECJ judgments of Viking and Laval exemplify the unresolved tension between the EU's strong market imperatives and its fragile social aspirations while the ongoing economic crisis, while the various 'bail out' packages are producing a constant retrenchment of social rights. The status quo is one in which workers appear to shoulder most of the risks attendant on making and executing arrangements for the doing of work. Chapters in this book advocate a reversal of this trend in favour of fair mutualization, so as to disperse these risks and share them more equitably between employers, the state, and society at large.

The focus of this paper will be on the use of short-time work as a way of saving companies against the background of the current corona pandemic. In this context, it is particularly important to find out what additional measures have been taken to help companies during this period and, in particular, how short-time work can be used to build a bridge for companies to survive this pandemic in the sea of economic consequences. In April, as a result of the corona pandemic, unemployment figures increased by 308,000 in Germany alone to a total of 2.65 million. Unemployment is expected to climb to more than 3 million. The economy is virtually at a standstill, orders are stagnant, the population is at home and money is no longer flowing. Cancellations of trade fairs and large-scale events, and the decline in travel, are affecting the service sector, especially in the areas of logistics, trade, gastronomy, and tourism. At the same time, foreign demand is dropping, and international supply chains are being disrupted, which impacts production in Germany. The corona pandemic is hitting companies hard and help is undoubtedly needed if jobs are to be maintained. One form of such help is short-time working. More than half of all German companies have announced short-time work. Introducing short-time work is known to safe companies and maintain jobs through difficult times like these. According to Anke Hassel, a professor of public policy at the Hertie School in Berlin, the policy is one of the reasons why Germany recovered so quickly after the 2008-9 financial crisis.
