III. ON SHORT SALES AND MANIPULATION. Samuel H. Ordway, who was a member of the Hughes Commission, discusses manipulation and short selling in Scribners Magazine (Sept. 1909): It is extremely difficult, if not impossible, to devise any safe system of legislation to restrict the manipulation of prices. No one has yet been able to suggest a form of statute which will prevent improper manipulation of prices and will at the same time permit legitimate transactions on a large scale. Short selling has been the subject of constant attention and very serious criticism from the public and the press. It is difficult to see why it is economically or morally wrong to agree to sell something that one does not possess but expects to obtain in the future, any more than it is to agree to buy what one has not the money to pay for at the present time but expects to have the money to pay for later on. Contracts and agreements to sell and deliver in the future commodities which one does not possess at the time of the contract and common in all forms of business. The manufacturer sells what he has not yet produced; he must do so to keep his factory open and his hands employed the year around; the farmer agrees to sell his growing crop; the contractor agrees to deliver the house built of bricks he has not yet purchased and with labor he has not yet contracted for; and so on ad infinitum.
