To date, thirty-one states and the District of Columbia have recognised a journalists' privilege through enactment of press 'shield laws', which protect the relationship between reporters, their source, and sometimes, the information that may be communicated in that relationship. The journalists' privilege is distinct from other recognised privileges, in that the privilege vests only with the journalist, not with the source of the information. This book provides an overview of general trends among the states individual statutes. It also presents the full text of the state shield statutes and the First Amendment.

Book excerpt: This research helps to identify the history of attempts at passing a federal shield law for journalists in the United States, tracing back to when the need was originally recognized after the Supreme Court’s landmark Branzburg v. Hayes decision in 1972. The research also aims to help determine where journalists stand today, based on state statutes and court precedents, in terms of three pertinent issues: revealing anonymous sources, handing over newsgathering materials, and prosecuting journalists under the Espionage Act. To find this information, different historical and legal research methods were applied. By tracing through previous research, online guides and news articles, a better picture is painted of the history of these issues, and the attempted legislative processes can be better understood. It seems the current state of affairs in the United States leaves the media largely unable to fulfill their role of serving as the Fourth Estate by serving as a system of checks and balances for the other three branches of government due to their lack of legal protection, and the American people are the ones left to suffer.

A legislation called shield law or reporter's privilege protects journalists from being compelled to testify about confidential information, simplifies the situation regarding sources of delicate information, and ultimately advances the free flow of information in society.The rudimentary objectives of shield laws are widely accepted in democratic societies. The goal is to promote open communication about important but sensitive topics. In the absence of a privilege journalists would be more cautious of the consequences of their stories and sources would communicate less openly. If the sources believe that their identities may be disclosed, the future news sources may be hesitant to provide information and public discussion would suffer from so called chilling effect.In spite of rather commonly shared understanding of the benefits of shield laws as a vital part of journalisms watchdog function, there is a great deal of variations on how privilege is regulated in different countries, states, and territories. The scope of shield law, persons covered, interpretation power of judges, and exceptions for the main rule vary considerably among jurisdictions. The differences reflect not only details of stipulation but also fundamental principles behind the objectives of legislature.The balance between encouraging access to information and maintaining effective justice system is the core of the variations between jurisdictions. In order to gather sensitive/delicate news, journalists must sometimes guarantee their sources' confidentiality. Courts and judges, on the other hand, have a competing interest in obtaining the information they need to prosecute criminal cases. The approach on this balance delineates the special characteristics of journalist's privilege in each jurisdiction.This paper presents a classification of shield law legislations based on comparisons within and among Australia, Finland, Germany, Norway, Sweden, and the US.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel.
