The text examines how and why anthropology and culture became part of wider socio-political discourses in Iran, and how they were appropriated, and rejected, by the pre- and post-revolutionary regimes. The author highlights the three main phases of Iranian anthropology, corresponding broadly to three periods in the social and political development of Iran: *the period of nationalism: lasting approximately from the constitutional revolution (1906-11) and the end of the Qajar dynasty until the end of Reza Shah’s reign (1941) *the period of Nativism: from the 1950s until the Islamic revolution (1979) *the post-revolutionary period. In addition, the book places Iranian anthropology in an international context by demonstrating how Western anthropological concepts, theories and methodologies affected epistemological and political discourses on Iranian anthropology.

Book excerpt: This work investigates the problem of how constitutionality and the internationally increasingly accepted global principles of human rights can influence state action, which is still considered sovereign. International human rights regulations are of pre-eminence in this context since they are virtually, by definition, based on limitations of national constitutional law, in order to assert internationally shared constitutional principles. The evolution of international human rights - triggered by the Holocaust trauma - was the first serious challenge pertaining to any kind of domestic action within the sovereignty of states. This new type of global morality that manifests itself in international relations largely owes itself to the emergence of the notion that certain states bear responsibility for the horrors of World War II. The first part will review the resultant limitation of sovereignty in the context of the creation, amendment, and interpretation of national constitutions, seeking to answer the questions of how far the process of internationalization of (national0 constitutional law has progressed. The second part will address the constitutionalization of the small segment of international law that manifest itself in the assertion of international human rights standards in the case law of national courts.

In this ambitious and topical book, a Muslim scholar and human rights activist envisions a positive and sustainable role for Shari‘a, based on a profound rethinking of the relationship between religion and the secular state in all societies. An-Na‘im argues that the coercive enforcement of Shari‘a by the state betrays the Qur’an’s insistence on voluntary acceptance of Islam. Just as the state should be secure from the misuse of religious authority, Shari‘a should be freed from the control of the state. State policies or legislation must be based on civic reasons accessible to citizens of all religions. Showing that throughout the history of Islam, Islam and the state have normally been separate, An-Na‘im maintains that ideas of human rights and citizenship are more consistent with Islamic principles than with claims of a supposedly Islamic state to enforce Shari‘a. In fact, he suggests, the very idea of an “Islamic state” is based on European ideas of state and law, and not Shari‘a or the Islamic tradition. This revolution, which resulted in the establishment of Iran's first parliamentary democracy, was a seminal event in the country's history. The most thorough and comprehensive history of the revolution to date, Bayat's book examines the uneasy alliance of clerical, bureaucratic, landowning, and mercantile elements that won the support of the masses for a more democratic government, especially the clerical dissidents that gave the revolution an aura of religious legitimacy. Bayat argues that the recent religious revival in Iran is much less surprising when one sees how constitutionalists at the beginning of the century had to couch their calls for reform in the language of the Koran, claiming that political reforms constituted a return to Islam.
