Book excerpt: The Treasury Sub-Committee calls for much greater transparency from the Treasury in accounting for the liabilities taken on by the nationalisation and part-nationalisation of financial institutions. The report recommends that these disclosures appear in the annual Treasury resource accounts. Furthermore they should be at least as comprehensive as those made by major corporations and go further than meeting the minimum acceptable accounting standards. In particular, the Report notes that the Treasury's 2007-08 Annual Report and Accounts cover the Government's financial relationship with Northern Rock but do not comment on its performance under temporary public ownership. Given the level of interest in the fully nationalised institutions of Northern Rock and Bradford & Bingley, and the Treasury's role in their governance, the report recommends that key performance information for these institutions be published in the resource accounts as well. The wholesale nationalisation of Northern Rock, and Bradford & Bingley has created governance responsibilities for the Treasury while these entities remain under public ownership. The Government's announcements of October 2008 created further responsibilities regarding the oversight of part-nationalised banks, and created a new body, UK Financial Investments (UKFI). The report calls for UKFI to report annually to Parliament and to be accountable to the Treasury Committee. The Committee wants the Government to identify and publish performance indicators for UKFI, and to report against these measures on a six-monthly basis. All these developments are additional challenges for the Treasury and require it to act in areas its current staff base may not be fully equipped for or familiar with. The Government must ensure the Treasury is sufficiently resourced to manage the extended responsibilities arising from the economic downturn, especially those regarding financial stability.

Book excerpt: Following the Treaty of Lisbon, The European Council has been given the power to adopt and implement an internal security strategy. it did so in March 2010, and this was followed in November by a Commission communication setting out the priorities, and how to implement them. The communication sets out five steps towards a more secure Europe: The disruption of international crime networks, The prevention of terrorism, security in cyberspace, improved border management, and increased resilience to crises and disasters. Of these cyber-security is a comparative newcomer and it is now clear that it can lead to massive disruption of state infrastructure, and can be used for espionage, terrorism, even war. As such, much of the evidence received concerned the role which the EU might play in fighting cyber-attacks. The Commission's main proposal is to set up a new Cybercrime Centre. This might be no more than a talking shop, but it could become a useful tool for investigating and analysing past attacks, improving law enforcement and preventing future attacks. Much will depend on whether it is given adequate resources. The Committee looked at the implementation of the strategy and at the way in which it overlaps with national and international strategies, In the hope that they can be mutually supportive. The Council has a new committee, which, under the Treaties, has the duty of coordinating all the work on internal security. Unless it does so effectively very little can be achieved; if it properly fulfils its mandate, The EU may play a valuable role in protecting the security of its citizens.

Book excerpt: The Joint Committee on Human Rights calls for a fundamental, independent review of the necessity for and proportionality of all counter-terrorism measures adopted since September 11 2001. It questions the way that the policy imperatives of national security and public safety have been used to justify squeezing out human rights considerations. Since September 11 2001, the Government has continuously claimed that there is a "public emergency threatening the life of the nation". The Committee questions whether the country has really been in this state for over eight years. A permanent state of emergency skews public debate about the justification for rights-limiting counter-terrorism measures. It is unacceptable that the Director General of the Security Service refuses to appear before it to give public evidence - despite giving public lectures and media interviews. The Committee finds the Government's narrow definition of complicity in torture significant and worrying and calls for an urgent independent inquiry into the allegations of complicity in torture. The Government should drop the draft bill still being held in reserve to allow pre-charge detention to be extended to 42 days. And more work should be done on measures - such as bail and the use of intercept evidence - that could reduce the use of pre-charge detention. The Intelligence and Security Committee should become a proper Parliamentary committee with an independent secretariat and legal advice and appointing an independent reviewer of counter-terror legislation who reports directly to Parliament not the Government.

Book excerpt: The United Kingdom retains responsibility for 14 Overseas Territories, 11 of which are permanently populated and which choose to remain under British sovereignty rather than to become independent states. The Foreign and Commonwealth Office (FCO) is the lead Department for coordinating UK Government policy for the Territories. The Department for International Development (DFID) coordinates development assistance, focusing on the three Territories of Montserrat, St. Helena and Pitcairn. This report examines the oversight of offshore financial services in the Territories; the balance between UK and Territory funding and responsibilities; and governance and management of the Territories external relations. The FCO aims to strike a balance between maximising the autonomy given to Territories' democratically elected governments, and minimising risks to the UK. The UK has dealt with a wide variety of risks and liabilities in the past, including pension liabilities of an estimated £100 million in Gibraltar and emergency aid of over £250 million to Montserrat after a volcanic eruption on the island. Territories have seen improvements in disaster management, but this needs to accelerate as rising sea levels and global warming add to the existing risks from hurricanes and volcanoes. The FCO is attempting to increase capacity for oversight of Territories' financial services industries, but regulatory standards in most are low. Limited capacity also reduces the ability of Territories to investigate and prosecute money laundering. Standards of governance and financial reporting in the Territories are variable and can fall below standards acceptable in UK local government. Lax financial management can evade departmental controls to protect the UK from risk, although there is stronger fiscal oversight of Territories receiving development aid.

Book excerpt: The Constitutional Reform and Governance Bill was re-introduced in the House of Commons on 19 November 2009 and the Committee welcomes a number of aspects of the Bill which is implementing some of the commitments made by the Prime Minister in his Governance of Britain statement in July 2007. But the Committee considers there are a number of significant omissions from the Bill including in relation to judicial appointments, parliamentary scrutiny of security and intelligence matters, and the restrictive judicial interpretation of the meaning of public function in the Human Rights Act. They recommend amendments relating to the latter two points. They also look at Protest around Parliament, Ratification of Treaties and Right to a fair hearing and access to a court in the determination of civil rights.The Video Recordings Bill was introduced into the House of Commons on 15 December 2009 and is a fast track piece of legislation which repeals and revives the provisions of the Video Recordings Act 1984 in order to enable them to be notified to the European Commission under the Technical Standards Directive and so secure its enforceability. The Committee considers the human rights issues raised by this Bill should be subjected to parliamentary scrutiny. However as the 1984 Act, serves as an important child protection purpose, that are currently unenforceable, the Committee accepts the need for fast tracking this legislation and does not propose to further scrutinise this Bill.

Difficulties may arise if there are weaker governance mechanisms for protecting human rights overseas, or if firms take different approaches to the protection of certain human rights in the UK and elsewhere. This report considers a complex range of issues, starting from the position that the UK should play a leadership role to ensure that all firms respect human rights wherever they operate. The work of the UN Secretary General's Special Representative on Human Rights and Transnational Corporations is welcome but the Committee would support clearer guidance for meeting obligations. The OECD also has guidelines on multinational enterprises as monitored by National Contact Points. The UK National Contact Point, though much improved, still falls short of the necessary criteria and powers needed by an effective remedial body. The Committee argues that an international agreement on business and human rights should be the ultimate objective, although they accept that no such agreement is likely in the near future. There is considerable scope for joint working on a regional level and globally to agree a consistent approach to business and human rights and the Committee believes that the UK Government could do more to explain the responsibility on businesses to respect human rights and the standard of due diligence this entails
