Book excerpt: This book, first published in 2005, develops a comparative model of intergovernmental bargaining to account for variation in the capacity of federations in the developing world to undertake economic policy reform, suggesting that many market reform policies are a function of a constant process of bargaining between national and regional leaders struggling for political survival. As the degree of national-regional disagreement mounts, collective action on reforms that require implementation at multiple levels of government becomes more difficult. The degree to which the two factors conflict depends on four factors: the individual electoral interests, a shared intergovernmental fiscal system, the manner in which regional interests are represented in national policy making and the levers of partisan influence national leaders have over subnational politicians. In testing the argument with a combination of cross-sectional time-series and case study analysis, this book contributes to the broad literatures on development and the comparative political economy of federalism and decentralization.

Not even the most talented, dedicated, well-compensated, well-trained, and well-led public servants can serve the public well if they must operate under perverse personnel and procurement regulations that punish innovation and promote inefficiency. Many attempts have been made to determine administrative problems in the public service and come up with viable solutions. Two of the most important—the 1990 report of the National Commission on the Public Service, led by former Federal Reserve chairman Paul A. Volcker, and the 1993 report of the National Commission on the State and Local Public Service, led by former Mississippi Governor William F. Winter—recommended "deregulating the public service." Deregulating the public service essentially means altering or abolishing personnel and procurement regulations that deplete government workers' creativity, reduce their productivity, and make a career in public service unattractive to many talented, energetic, and public-spirited citizens. But will it work? With the benefit of a historical perspective on the development of American public service from the days of the progressives to the present, the contributors to this book argue that deregulating the public service is a necessary but insufficient condition for much of the needed improvement in governmental administration. Avoiding simple solutions and quick fixes for long-standing ills, they recommend new and large-scale experiments with deregulating the public service at all levels of government. Book excerpt: La noción jurídica de servicio público resulta ser producto de un laborioso proceso teórico de elaboración hasta nuestros días, en el que participan de consuno la legislación, la jurisprudencia y la doctrina científica de Derecho administrativo comparado. Desde entonces la noción jurídica es empleada, tanto por el legislador como también es puesta en obra por el Juez administrativo y también, más recientemente, por el Juez constitucional. Su invocación justifica la aplicación de reglas de Derecho público específicas —denominadas inicialmente como exorbitantes del Derecho común aplicable entre los sujetos privados—. Por ello, el servicio público es desde sus mismos orígenes, una institución emblemática pero, también, sin duda, una de las más controversiales, que J. Morand-Deviller resume, así: "El servicio público es sin duda, la noción más compleja, evolutiva, controvertida y esencial del derecho administrativo”. De cualquier modo, hemos de interrogarnos si el servicio público sigue siendo una realidad innegable en los Derechos positivos de algunos países de la Europa Continental y de América Latina, que han sido históricamente recipiendiarios del Derecho administrativo francés, como categoría jurídica de que se sirve el Estado Constitucional —que no la única—, para cumplir su responsabilidad constitucional indeclinable de satisfacer necesidades o demandas esenciales o vitales de la Sociedad. Por consiguiente, la búsqueda de la dimensión jurídica es, pues, una cuestión de plena actualidad, por lo demás apasionante en un ambiente de economía global, de mercado y de libre competencia y de procesos de crisis y, de consiguiente, reconfiguración —revisión y actualización—, que quizás —o sin el quizás—, como ningún otro sector se ha transformado de modo trascendental en las últimas décadas. En esta obra haremos referencia a la noción jurídica de servicio público en su sentido estricto y propio, desde una nueva perspectiva, contemporánea, en razón de un cambio de fondo, jurídico y político, del modelo de regulación que ha presidido hasta hoy los sectores calificados con arreglo al Derecho de los Servicios Públicos.
