Book excerpt: Historically, the announcement and invocation of criminal penalties were public spectacles. Today, fear of crime and disaffection with the criminal justice system guarantee that this public fascination with punishment continues. In the past decade, virtually every legislature in the country has undertaken sentencing reform, in the hope that public concern with crime would be allayed and dispari ties in criminal sentences would be reduced if not eliminated. Scholars have intensified their longstanding preoccupation with discrimination and the sources of disparate treatment during sentencing - issues that continue to fuel contem porary reform efforts. As documented in Chapter 1, empirical research on sen tencing has concentrated much of its attention on the offender. Only recently have attempts been made to imbed sentencing in its broader organizational and social contexts. Our study extends these attempts by quantitatively analyzing the relationship between the offender and the social contexts in which he or she is sentenced. We use data on felony sentencing in Georgia between 1976 and 1985 to ask three questions. The first addresses an issue of perennial concern: during sentencing, how important are offender attributes, both those of explicit legal relevance and traits whose legal relevance is questionable or nonexistent? The second question directs attention to the social contexts of sentencing and asks whether they directly affect sentencing outcomes.

Book excerpt: While historical research has noted the importance of the family in criminal justice, recent empirical work has tended to neglect the emphasis placed on the family in the criminal process. Drawing on Daly s work on familial justice, this paper investigates the role of the family in the sentencing of offenders in a specialized domestic violence court. We examine both the likelihood of incarceration and the determinants of sentence length, and find that conceptions of the family continue to have an important influence on these criminal process outcomes. In cases in which the victim has suffered serious injuries, offenders in intact relationships are more likely to be sentenced to jail, yet, at the same time, when incarcerated, these offenders receive shorter sentences. Thus, even as researchers are documenting broader shifts away from the promotion of substantive values through the criminal process, the current study suggests the continued relevance of family-based justice in the sanctioning of offenders, so that moral imperatives continue to intersect with the actuarial logic of modern penal practices.

Book excerpt: Domestic violence research is an important part of both scholarly and practitioner investigations into the circumstances and legal outcomes of domestic violence incidents. To improve upon our current understanding of domestic violence court cases, this study utilizes data from the Ninth Judicial Circuit Court of Florida to examine the relationship between socio-demographic factors and domestic violence case dispositions. Using Generalized Estimating Equation modeling, Black's theory of the quantity of law, which proposes that the quantity of law observed between parties varies based on individual characteristics, is used to investigate the relationship between individual case characteristics and domestic violence case disposition outcomes. Findings from this study suggest that different stages of the disposition outcome are related to petitioner and respondent characteristics, and legal and injury factors. The findings from this study are useful to those that are interested in developing a better understanding of the relationship between domestic violence case characteristics and the resulting court dispositions.

Book excerpt: Scholars, the media, and the public have been concerned about differing values placed on crime victims on the basis of social factors such as gender, race, and domestic violence affiliation. Some academics argue that specific victim attributes result in more punitive sentencing to be imposed, particularly if the victim is constructed as "ideal". An ideal victim is one who is socially constructed as more "worthy" than another victim of crime based on personal attributes, behaviors and situational aspects of their victimization. International and domestic Canadian sentencing research, however, has demonstrated inconsistent results regarding the role of key victim attributes of gender, race and domestic violence status in sentencing. This study uses the theoretical perspective of social constructionism to guide an assessment of what impact victim gender, race, and domestic violence affiliation may have on sentencing and evaluate the effect of other "ideal victim" factors on court sanctions. The research design also considers the perspective of legal rationalism and the influence of legal factors such as past criminal history, as well as aggravating and mitigating circumstances considered by judges in their sentencing decision. The study uses the crime of second-degree murder and the outcome of parole ineligibility length to test research hypotheses. Through legal case reports and media coverage, data was gathered on victim and offender demographic, social situation and legal background data on 259 cases of second degree murder from 1980-2017. There was little support for the influence of race and domestic violence attributes on murder sentencing. Gender did appear to increase sentence punitivity, even after control variables were introduced. Consistent with past research, demographic factors and ideal victim situational factors showed mostly weak effects on sentencing, while legal predictors such as prior criminal history, other aggravating and mitigating factors explained considerably more variance in parole ineligibility. Given the high evidentiary burden of second degree murder and its seriousness as a crime, it may be an offence less likely to show bias at the point of sentence. Researchers investigating bias might be better served examining manslaughter, assault and less serious offences. Given the limited evidence of domestic violence bias, it may be that governments should provide more resources directly to family violence offenders for rehabilitation and victims for social support. Finally, results should be interpreted cautiously given sampling limitations.
