Reagan National Defense Authorization Act for Fiscal Year 2005 (the NDAA). Section 3116 of the NDAA requires that (1) DOE consult with the NRC on its non-high-level waste determinations and plans, and (2) the NRC, in coordination with the covered States of South Carolina and Idaho, monitor disposal actions that DOE takes to assess compliance with NRC regulations in Title 10 of the Code of Federal Regulations (10 CFR) Part 61, “Licensing Requirements for Land Disposal of Radioactive Waste,” Subpart C, “Performance Objectives.” The NRC has prepared this report in accordance with NUREG-1854, “NRC Staff Guidance for Activities Related to U.S. Department of Energy Waste Determinations,” dated August 2007 (NRC, 2007a).

Book excerpt: Increasing public confidence in the U.S. Nuclear Regulatory Commission (NRC) as an effective and independent regulator is an explicit goal of the Agency (1). Consistent with long-established mechanisms and procedures, NRC provides the public access to its decision-making process. Recently, during the course of a rulemaking required by statute, NRC examined its means for inviting public access as well as the NRC staff's effectiveness in furthering public confidence in it's actions as a regulator. When developing new, site-specific regulations for the proposed geologic repository at Yucca Mountain, Nevada, NRC's Division of Waste Management found it necessary to adapt and improve its efforts to inform and involve the public in NRC's decision making process. Major changes were made to the way in which technical staff prepare for speaking to general audiences. The format used for public meetings was modified to encourage dialogue with participants. Handout and presentation materials that explain NRC's role and technical topics of concern in plain language were developed and are regularly updated. NRC successfully applied these and other institutional changes as it completed final regulations for Yucca Mountain and while developing and introducing a draft license review plan for public comment.

Available in PDF, EPUB and Kindle. Book excerpt: Several thousand sites exist in the United States where nuclear activities have been conducted over the past 30 to 40 years. Questions regarding potential public health hazards due to residual radioactivity and radiation fields at abandoned and inactive sites have prompted careful ongoing review of these sites by federal agencies including the Department of Energy (DOE) and the Nuclear Regulatory Commission (NRC). In some instances, these reviews are serving to point out poor low-level waste management practices of the past. Many of the sites in question lack adequate documentation on the radiological conditions at the time of release for unrestricted use or were released without appropriate restrictions. Recent investigations have identified residual contamination and radiation levels on some sites which exceed present-day standards and guidelines. The NRC, DOE, and Environmental Protection Agency are all involved in developing decontamination and decommissioning (D and D) procedures and guidelines which will assure that nuclear facilities are decommissioned in a manner that will be acceptable to the nuclear industry, various regulatory agencies, other stakeholders, and the general public.
