Book Louisiana Criminal Law

Download or read book Louisiana Criminal Law written by Bobby Marzine Harges and published by Vandeplas Pub.. This book was released on 2008-07-01 with total page 768 pages. Available in PDF, EPUB and Kindle. Book excerpt: Louisiana Criminal Law: Cases and Materials, Second Edition is a textbook designed for use in the basic Criminal Law course taught in a law school or an undergraduate program in Criminal Justice. The text includes cases from the state of Louisiana and statutes from the Louisiana Criminal Code. The format of this book is a combination of Louisiana criminal cases, statutes, comments and questions. Each chapter of the book begins with an introduction to the basic principles and crimes that will be discussed in the chapter followed by questions and comments. The cases have been selected because they reflect the issues of major importance regarding basic concepts of criminal law as interpreted by the Louisiana Supreme Court and Louisiana appellate courts. Selected provisions of the Louisiana Criminal Code are included in the Appendix. The questions at the end of the cases should assist students in developing their analytical skills and understanding of criminal law. The cases and statutory appendix should provide students with all the information they need to successfully answer the questions. The questions should assist in promoting relevant classroom discussions. After an introductory chapter discussing general principles contained in the Louisiana Criminal Code, the text contains chapters on the guilty mind including criminal intent and criminal negligence followed by chapters on justification and excuse including insanity, intoxication, self-defense, defense of property and defense of others; parties to crime and inchoate crimes; homicide; assault and battery; sexual offenses; kidnapping; arson; burglary; theft and robbery. About the authors: Bobby Marzine Harges is the Adams and Reese Distinguished Professor of Law II at Loyola University New Orleans where he has taught criminal law and criminal procedure since 1995. He received a J.D. from the University of Mississippi School of Law and an LL.M. from Harvard Law School. Gaynell Williams is the First Assistant District Attorney at the Orleans Parish, Louisiana District Attorney's Office. She received a B.A. from Loyola University New Orleans and a J.D. from Tulane Law School. After law school she served as an Assistant District Attorney for the Jefferson Parish District Attorney's Office and an Assistant United States Attorney in the Criminal Division of the United States Attorney's Office for the Eastern District of Louisiana.

Excerpt: ...the questions discussed in this note from others liable to bc confounded with them, in criminal law. The right to takeamcnds applies to many cases of private injuries; yet it is a nice question of fact, whether the amends taken were not intended to operate as a compounding of the public offence. And it is sometimes a nice question of law, whether the court will enforce an obligation given to pay for the private injury, as having been obtained under cirstances calculated to obstruct the course of public justice. It must be remembered that if, in a particular case, the plaintiff is not permitted to prevail in his civil suit, the consequence does not necessarily follow that he would be indictable. Sec 1 Bishop, Crim. Law, 505. H. A judge of an inferior court, acting in a case of which he has no jurisdiction, or exceeding his jurisdiction, is liable in damages to any party injured. Thus, a justice of the peace, who, in the course of the trial of a case of which n police court has exclusive jurisdiction, commits a witness to prison for contempt, is liable to an action by the witness. As the Police Court of Lowell has exclusive jurisdiction of all offences committed within that city, a record of a conviction, before a justice of the peace for the county of Middlesex, of an offence alleged to have been committed in the city of Lowell, shows primd facie n. want of jurisdiction in the justice. The record of a conviction by an inferior court must show, in ordcr to protect the justice from liability to n person imprisoned pursuant to such conviction, that the case was within the limits of his jurisdiction. Book excerpt: Excerpt from Leading Cases Simplified: A Collection of the Leading Cases in Criminal Law The present volume completes the series of Lead ing Cases Simplified. In my. First volume Common Law Cases) I stated my object to be to present the lead ing cases of the Common Law in a brief and semi humorous form. The favor with which my attempt was received induced me, in a second volume, to treat in the same way the leading cases in Equity and Constitutional Law. And in this third volume, both the student and the practitioner will be able, I think, to find all the leading cases and all the principles of the criminal law, as admin istered at common law and to some extent as altered by statute.
