This volume examines the current state of, and perspectives for, Social Europe, as well as key issues in European social policy, including the posting of workers, the impact of the free market and regulations on social convergence, work automation, digitalisation, taxation and democracy in the workplace. The aim of this volume is to identify a course to be followed in integrating the EU’s social policies and point to areas in which co-operation between member states is likely to produce best results. While a Social Europe was previously seen to be a natural consequence of political and economic integration, it is now viewed as a separate area that requires active policies to preserve the European project. The EU’s big question today concerns the level at which this policy should be pursued: the volume’s contributors outline difficulties with harmonising social policies across the Union, but they nevertheless argue that, owing to the common challenges faced by Europe, the idea of a Social Europe must not be abandoned and requires specific action. The volume consists of 11 chapters written by a variety of expert authors, analysing the idea of a Social Europe and proposing ways in which it could be put into practice. Social policy can no longer be seen as derived from economic policy but rather as a separate driver of development that could be of interest to the northern, southern and eastern states of the EU. The applicant states from Eastern Europe are much poorer than the current member states from Western Europe. Their democracy and in some cases even their statehood is newly established and presumably more fragile. Their economic, legal and administrative structures are less developed. This collection of essays will try to examine the origin, nature, scale and implications of this divergence. How much divergence is likely to be imported by the Union and will it hamper the process of European integration? This volume looks at differences and similarities in the field of macro-economics, welfare systems, democracy, institutional infrastructure, civic orientations and popular culture. The book shows that the map of convergence and divergence in the future EU will be very complex and will not correspond exactly with the old east-west divide. Moreover, the division lines are constantly changing with the enlargement process representing an important factor pushing individual states into a single regulatory frame, if not in a common political direction. However, there are other "unifying" factors at play: globalization produces different models and loyalties than Europeanization. Moreover, the European pulling effect works unevenly in different functional fields and in different countries. There are also many factors that produce greater divergence rather than convergence across the European Union; a certain degree of divergence is thus unavoidable. The book shows, in particular, that certain types of divergence can be beneficial rather than merely detrimental in the process of Europeanintegration.

This book examines the convergence between its two constituent systems: the damages liability of the EU and that of its Member States for failing to comply with EU rules. Member State liability, based as it is on the Francovich case (1991) and Brasserie du Pêcheur and Factortame (1996) judgments of the European Court of Justice (ECJ) is well established. But it is yet to be closely scrutinised by reference to the detailed rules on the liability of the European Union. The focus of the book is on the two key legal criteria that are common to both systems, namely the grant of rights to individuals by EU law and the notion of sufficiently serious breach of such rights. The analysis concentrates on developments in the case law of the ECJ and the General Court since the Bergaderm judgment (2000), which consolidated the convergence of the two liability systems that was first indicated in Brasserie du Pêcheur and Factortame. These two criteria are set side by side to evaluate the extent, in real terms, of the convergence of Member State and EU institutional damages liability, and to determine the extent to which one has influenced the other. This book shows that although full convergence between the two liability systems is not likely, each stream of case law should look to the other more actively as this important element of EU remedial law develops. Convergence in EU law public liability is supported by developments in adjacent areas, most notably European tort law and European administrative law. This study also illustrates how convergence in the EU liability systems to date has had spill-over effects into national public liability law.
