This is not because of a profound cultural divide between England and Scotland but because recent decades have seen the rebuilding of Scotland as a political community while the ideology and practices of the old unionism have atrophied. Yet while Britishness is in decline, it has not been replaced by a dominant ideology of Scottish independence. Rather Scots are looking to renegotiate union to find a new place in the Isles, in Europe, and in the world. There are few legal, constitutional or political obstacles to Scottish independence, but an independent Scotland would need to forge a new social and economic project as a small nation in the global market-place, and there has been little serious thinking about the implications of this. Short of independence, there is a range of constitutional options for renegotiating the Union to allow more Scottish self-government on the lines that public opinion seems to favour. The limits are posed not by constitutional principles but by the unwillingness of English opinion to abandon their unitary conception of the state. The end of the United Kingdom may be provoked, not by Scottish nationalism, but by English unionism.

For nationalists, they have been an 'arc of prosperity' while in the aftermath of the financial crash, unionists lampooned the 'arc of insolvency'. Both characterisations are equally misleading. Small states can do well in the global market place, but they face the world in very different ways. Some accept market logic and take the 'low road' of low wages, low taxes and light regulation, with a correspondingly low level of public services. Others take the 'high road' of social investment, which entails a larger public sector and higher taxes. Such a strategy requires innovative government, flexibility and social partnership. Keating and Harvey compare the experience of the Nordic and Baltic states and Ireland, which have taken very different roads and ask what lessons can be learnt for Scotland. They conclude that success is possible but that hard choices would need to be taken. Neither side in the independence debate has faced these choices squarely.

Book excerpt: Secessionist (also called, nationalist, or pro-independence) political parties exist in many countries in the developed world; they raise—and then spend—a lot of money, win votes in elections, and their elected officials serve in seats in local, regional, and national parliaments. Yet, despite all of this effort, there has not been a successful case of secession since 1921 when the Irish Free State effectively seceded from the United Kingdom (UK). Perhaps the biggest issue is that these secessionist political parties have rarely been popular enough to form a government even amongst their core ethnic group. This is further compounded by the fact that secessionist parties have historically been unable to win support from immigrants or people outside their core ethnic and/or linguistic group. Given this context, four central questions are posed in this study including: whether—and also why—any of the secessionist parties have transitioned from ethnic-based to civic-based policy platforms? Why have these secessionist parties not yet achieved independence? And, what role does the European Union (EU) play in facilitating or deterring secession in independence-seeking regions within member states? This study examines three different cases—Flanders in Belgium, Scotland in the UK, and Catalonia in Spain—to investigate how secessionist political parties are approaching the issue of independence. All of the cases are different with respect to history, governmental structure, and economic situation. Yet all of the cases are similar in some ways—they are close to the same size (in terms of population), operate within mature democratic political systems, have distinct secessionist political parties, and all reside within member states of the EU. Categorically, in all cases, there are also shared influences of the ability of the region to secede: institutions, interests, and ideas.

However, an analysis of the nationalism that the governing Scottish National Party adopts, a self-styled 'civic nationalism', shows several contradictions: a European Scottish nationalism (or European non-nationalist regionalism), an unacknowledged federalism in a centralist - and constitutionally still feudal - country as the UK is, and the absence of any understanding for a need for a modern written constitution to define a possible new and modern independent Scottish state. There also appear some similarities between the Scottish independence referendum of 2014 and the Brexit referendum of 2016: maybe the nationalist Scottish Government did not quite want to win the referendum anyway, just as the proponents of Brexit within the ruling Conservative Party in the UK did not quite want to win the Brexit referendum, either, but only sought political gain in a personal gamble?The following is a perhaps idiosyncratic discussion by a European about Scotland's drive for - and largely already achieved - autonomy within the UK, with an emphasis on the legal perspective. As this discussion concerns the UK, it cannot be divided from 'Brexit'. The chapter concerns the development of autonomy of a 'European' region within a country that has positioned itself outside Europe as a cultural space.

The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.
