For instance, prior to 1910, a County Superintendent was required to have certain qualifications and was elected by the County Board of Education; later this legislation was modified in part and later still the election and qualifications of this official were further changed. This is also true with regard to other parts of our school system. If the General Assembly will authorize the codification or systematic and logical arrangement of these laws, it will be a pleasure for the State Department of Education in conjunction with the Attorney-General to do this work without expense or cost of any kind, and in the interest of the public, I ask for the passage of an act to this effect. The publication of a complete compilation of Georgia School Laws and Decisions without such a re-arrangement merely confuses even the lawyers, to say nothing of the officials and parents. For this reason it has been thought wise to publish extracts of our more important and most necessary educational legislation until the right is granted to arrange the laws changed, omit those practically repealed, and to print a complete and thorough school code. The decision on page 140 is of great importance as fixing the relation between trustees and teachers. On the other hand, the authority of the teacher over the child has been noticeably narrowed. Such decisions as those on page 152 would probably be now impossible anywhere, and there is more and more recognition of the principle that the school is for the child, not the child for the school. The executive department shall consist of a Governor, Lieutenant Governor, Secretary of State, Auditor of Public Accounts, Treasurer, Superintendent of Public Instruction and Attorney General, who shall each with the exception of the Treasurer hold his office for the term of four years, from the second Monday of January next after his election and until his successor is elected and qualified. They shall, except the Lieutenant Governor, reside at the seat of government during their term of office, and keep the public records, books and papers there, and shall perform such duties as may be prescribed by law. Article VIII. Education. Section 1. The General Assembly shall provide a thorough and efficient system of free schools, whereby all children of this State may receive a good common school education. 2. All lands, moneys, or other property, donated, granted or received for school, college, seminary or university purposes, and the proceeds thereof, shall be faithfully applied to the objects for which such gifts or grants were made. 3. Neither the General Assembly nor any county, city, town, township, school district, or other public corporation, shall ever make any appropriation or pay from any public fund whatever, anything in aid of any church or sectarian purpose, or to help support or sustain any school, academy, seminary, college, university, or other literary or scientific institution, controlled by any church or sectarian denomination whatever; nor shall any grant or donation of land, money or other personal property ever be made by the State or any such public corporation, to any church, or for any sectarian purpose.
