Book excerpt: This volume offers an evaluation of the Schengen Information System and border control co-operation from a transparency and proportionality perspective. It also incorporates a legal descriptive analysis of the co-operation in order to accommodate the changes and developments that occurred during the writing period. The transparency and proportionality perspectives are developed from human rights and data protection criteria. Transparency is understood as knowledge and accessibility to legal information as well as openness and accountability. On the other hand, proportionality is a requirement for guidance, balance and justification as well as a need to avoid excessiveness and arbitrariness in border control work. The final findings reveal that the Schengen co-operation suffers from a deficiency of transparency and proportionality. Consequently, measures are proposed to augment the deficiency. Even as this study was reaching its conclusion, fundamental legislative changes, closely similar to some of the arguments and recommendations projected in this study, took place. The efficacy of these changes is yet to be discerned.

Book excerpt: Signed in 1985 by France, Germany, Belgium, Luxembourg, and the Netherlands, the Schengen Agreement had a significant impact on the integration of the European Community/European Union, particularly by providing for the gradual abolishment of border controls to facilitate the free movement of persons within the "Schengenland," i.e. the area of the states participating in the Schengen Agreement. Initially an intergovernmental agreement, later it was incorporated into the E.U.'s framework under the Amsterdam Treaty. Now the Schengen acquis, consisting of the set of rules of all the agreements, conventions, accession protocols, decisions and declarations accepted by the Schengen bodies, has become an integral part of 15 countries, two of which are non-E.U. states. It allows people, who reside or visit any of these 15 countries, to freely travel and move within each other's internal borders. This thesis' main purpose is to explore the major factors and people who initiated and influenced the acceleration of removing the border and customs controls. Also, the thesis will describe the political and economic implications of the consequent development of the Schengen Agreement.

The triptych of indentities, borders and orders is central to understanding the nature of sovereignty and the relations between countries. Nowhere is this more apparent than in the European Union. The changing definition and placement of the border is one of the most striking features of the recent transformations of the Union. The definition of what a border is and where it is for persons has moved out of the territory of national sovereignty and has become the preserve in law of the European Community. The enlargement of the European Union towards the countries of Central and Eastern Europe has created new challenges for the concept of borders in the EU. This volume examines the extent of the Community power and the legal meaning of the EU's borders, as well as the ways to control (or not) the movement of persons across borders. Book excerpt: Since its launch in 1995, the majority of personal data held in the Schengen Information System (SIS) concerns third-country nationals to be refused entry to the Schengen territory. This study reveals why the use of the SIS (and the second generation SIS or SIS II) entails a risk to the protection of human rights such as the right to privacy and the right to data protection, but also the freedom of movement of persons and the principle of non-discrimination. This study describes the implementation of the SIS in respectively France, Germany, and the Netherlands and the available legal remedies in both data protection and immigration law. On the basis of three general principles of European law, minimum standards are developed for effective remedies for individuals registered in the SIS, but also other databases such as Eurodac or the Visa Information System.
