Book Precautionary Rights and Duties of States

Download or read book Precautionary Rights and Duties of States written by Arie Trouwborst and published by BRILL. This book was released on 2006-06-01 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: Concluding that the precautionary principle embodies customary international law is one thing. Determining what this means is quite another. That challenge is met by this work, which resolves a number of crucial questions concerning the scope of this principle of international environmental law; the conditions triggering a right or duty to take precautionary action; the measures to be taken; the allocation of the burden of proof; and the role of socio-economic factors. These questions are dealt with one at a time through the charting and analysis of patterns and common denominators in the extensive (inter)national practice of states regarding the precautionary principle. The hard legal core of the principle is thus gradually exposed. In the process, a realistic and accessible account is given of how and to what extent this general principle can and does direct the actions of states in concrete instances. Ultimately, this work sets out what it takes to act in conformity with the precautionary principle under general international law, and will be of interest to anyone involved with international law and environmental protection.

Book Forest Certification A Policy Perspective

Download or read book Forest Certification A Policy Perspective written by Chris Elliott and published by CIFOR. This book was released on 2000-01-01 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper analyses the development of certification programmes in three countries (Indonesia, Canada and Sweden) using the Advocacy Coalition Framework (ACF) as a theoretical reference point. The ACF is an actor-based framework for analysing policy processes and has not previously been applied in a developing country. Actors in the three countries took different approaches to certification. In Canada, in a programme development process supported by the forest products industry, a management systems approach was taken. In Sweden, performance standards were developed in a process initially driven by NGOs. In Indonesia, certification was led by an NGO within a framework established by government, and a performance standards approach was used. The paper concludes that forest certification can be best understood as a policy instrument that promotes and facilitates policy-orientated learning among actors, and provides indirect incentives for improved forest management. Learning occurs both as the standards to be used for certification are developed, and as they are implemented. The benefits of learning and consensus building among actors (such as NGOs, forest companies, private forest owners, indigenous peoples, governments, etc.) who have traditionally been in conflict with each other can be significant. On the other hand, where fundamental changes in forest policy (such as tenure and forest revenue reform) are needed, certification should not be seen as a substitute for these A further conclusion is that, while public policies change over periods of decades, the private policies of retailers and forest product companies can adapt more rapidly to changing circumstances. The concept of a ‘fast track’ of private policy change, compared to the slower track of governmental policy change, is therefore proposed and described. A number of interesting theoretical and empirical avenues for further research on certification are discussed.

Book Biodiversity Carbon Storage and Dynamics of Old Northern Forests

Download or read book Biodiversity Carbon Storage and Dynamics of Old Northern Forests written by Erik Framstad and published by Nordic Council of Ministers. This book was released on 2013 with total page 134 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmentally sound disposal of Ozone Depleting Substances is increasingly recognised as an important issue in terms of both the protection of the ozone layer and the effect on climate change. However, there is only a limited overview in the Nordic countries of product groups containing Ozone Depleting Substances, regulation of the substances, available treatment technologies, and waste infrastructure etc. This report provides an overview of the waste treatment and regulation of Ozone Depleting Substances in the Nordic countries. The report identifies gaps, proposes solutions and provides recommendations for relevant Nordic efforts within the area.

Book Developing Principles and Models for Sustainable Forestry in Sweden

This book was released on 2013-04-18 with total page 489 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book is summarized those management principles that should be valid in areas where forests continuously are used for production, where biodiversity aspects are important as well as economy and productivity, and where demands on soil status and water quality are set. Especially the very long-term aspects are emphasized, and it is shown how system model thinking is used to reach the goals. Biogeochemical aspects are put forward as they are very important in areas on poor bedrock with acid soils. Forest vitality and stress on trees are treated, as well as the importance of wildlife and their effects of browsing. The balance between social and recreational demands from the society and the economical needs of the landowner is of great concern. Experiences from a special area in South Sweden are presented.
