Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.

This type of reasoning is being used to justify the destruction of social rights of citizens for the profit of the private sector, resulting in more limited access to the most fundamental resources such as water, nature, housing, culture, knowledge and information, mainly for the most vulnerable members of society. Such a view, informed solely by short-term growth and profit cycles, is endangering access to those resources not only for current generations but for future ones as well. This book is an attempt to go beyond liberal approaches to intergenerational and distributive justice. It emphasises the role of commons and communities of the commons, driven by the desire to defend and perpetuate those fundamental resources under the threat of expropriation by the state and the market. This book also offers policy makers and citizens, who wish to accept their political responsibility by being active and refusing corporate ideology, some best practices as well as methods and solutions for renewing the configurations of societal relationships through commons, thereby integrating the interests of future generations in the European Community’s decision-making processes and institutions. In the past decades, a new awareness of the importance of indigenous rights has emerged at the international level. UN organs have adopted specific international law instruments that protect indigenous peoples. Nonetheless, concerns persist because of continued widespread breaches of such rights. Stemming from a number of seminars organised at the Law Department of the University of Roma Tre, the volume includes contributions by distinguished scholars and practitioners. It is divided into three parts. Part I introduces the main themes and challenges to be addressed, considering the debate on self-determination of indigenous peoples and the theoretical origins of ‘indigenous sovereignty’. Book excerpt: This book states that whilst academic research has long been grounded on the idea of western or scientific epistemologies, this often does not capture the uniqueness of Indigenous contexts, and particularly as it relates to the achievement of the United Nations Sustainable Development Goals (SDGs). The SDGs were announced in 2015, accompanied by 17 goals and 169 targets. These goals are the means through which Agenda 2030 for sustainable development is to be pursued and realised over the next 15 years, and the contributions of Indigenous peoples are essential to achieving these goals. Indigenous peoples can be found in practically every region of the world, living on ancestral homelands in major cities, rainforests, mountain regions, desert plains, the arctic, and small Pacific Islands. Their languages, knowledges, and values are rooted in the landscapes and natural resources within their territories. However, many Indigenous peoples are now minorities within their homelands and globally, and there is a dearth of research based on Indigenous epistemologies and methodologies. Furthermore, academic research on Indigenous peoples is typically based on western lenses. Thus, the paucity of Indigenous methodologies within mainstream research discourses present challenges for implementing practical research designs and interpretations that can address epistemological distinctiveness within Indigenous communities. There is therefore the need to articulate, as well as bring to the nexus of research aimed at fostering sustainable development, a decolonising perspective in research design and practice. This is what this book wants to achieve. The contributions critically reflect on Indigenous approaches to research design and implementation, towards achieving the sustainable development goals, as well as the associated challenges and opportunities. The contributions also advanced knowledge, theory, and practice of Indigenous methodologies for sustainable development.

Book excerpt: Global public goods (GPGs)--the economic term for a broad range of goods and services that benefit everyone, including stable climate, public health, and economic security--pose notable governance challenges. At the national level, public goods are often provided by government, but at the global level there is no established state-like entity to take charge of their provision. The complex nature of many GPGs poses additional problems of coordination, knowledge generation and the formation of citizen preferences. This book considers traditional public economy theory of public goods provision as oversimplified, because it is state centered and fiscally focused. It develops a multidisciplinary look at the challenges of understanding and designing appropriate governance regimes for different types of goods in such areas as the environment, food security, and development assistance. The chapter authors, all leading scholars in the field, explore the misalignment between existing GPG policies and actors' incentives and understandings. They analyze the complex impact of incentives, the involvement of stakeholders in collective decision making, and the specific coordination needed for the generation of knowledge. The book shows that governance of GPGs must be democratic, reflexive--emphasizing collective learning processes--and knowledge based in order to be effective.
