Book excerpt: Il y a en France un double mouvement, une tension permanente entre la logique du droit des étrangers et celle des droits de l'homme, qui se cristallise autour de la santé des non-nationaux.La santé est intégrée au sein de la police administrative spéciale afin de protéger la collectivité de risques induits par l'arrivée d'étrangers malades. Mais d'autres enjeux que la préservation de la santé publique sont présents. La santé des étrangers est utilisée comme un moyen de régulation des flux migratoires et de sélection parmi les individus. La mise en œuvre de la politique dite de « l'immigration choisie » est cependant encadrée par les droits fondamentaux reconnus progressivement aux étrangers.La santé est également un droit des étrangers résidant en France, celui d'accéder aux soins nécessaires à leur état. Ce droit est porté par les principes d'égalité et de dignité, mais également dépendant de leur application par les juges. Le principe d'égalité conduit ainsi à une catégorisation du droit d'accès aux soins en fonction de la situation administrative des étrangers. Ce droit connaît en outre des variations importantes et se résume parfois au seul bénéfice de soins vitaux et/ou essentiels. Pour des considérations migratoires mais aussi financières, les juges font le choix de le rattacher au principe de dignité plutôt qu'à un droit, autonome, à la protection de la santé.

Par ailleurs, un nouvel environnement se dessine dans le monde du travail, avec l'arrivée de nouvelles technologies, de normes de travail différentes, l'augmentation des activités économiques indépendantes, et une plus grande flexibilité en matière de temps de travail et de pratiques sur le lieu de travail. Pour cette raison, certains pays européens ont adopté de nouvelles lois et de nouvelles politiques pour attirer les ouvriers étrangers hautement ou moyennement qualifiés. Cependant, les nouvelles mesures peuvent mettre en danger certains acquis dans ce domaine et peuvent ne pas être en accord avec les normes du Conseil de l'Europe visant à garantir les droits des travailleurs migrants, tels que la Charte sociale européenne et la Convention européenne relative au statut juridique du travailleur migrant. Cette étude se concentre sur les règles concernant le statut juridique des principales catégories de travailleurs migrants admis aux fins d'un emploi dans certains Etats membres du Conseil de l'Europe. L'étude examine la question essentielle de savoir si ces règles nationales sont conçues de manière à aider les migrants à s'intégrer dans le pays d'accueil, en leur garantissant un statut de résidence stable et l'accès aux droits sociaux, ou si elles découragent ou même empêchent une telle intégration.

Irregular migration has become a major political concern both at the European level and in the wider international context. In the European Union, politicians have identified irregular migration as a “problem” and have given priority to preventing this phenomenon in the development of the common asylum and immigration policy. This collection of essays is the outcome of an international conference on Irregular Migration and Human Rights, which gathered together prominent scholars, policy-makers and practitioners working in the migration and human rights field. The objective of the book, in contrast to the prevailing political approach which focuses almost solely on prevention, is to discuss the human rights dimensions of irregular migration from theoretical, European and international perspectives. The book is divided into five substantive parts: the complex question of who is an irregular migrant and the difficulties in assessing the size of irregular movements: official and popular perceptions of irregular migrants, a debate which is frequently considered in terms of security concerns, asylum, and human trafficking and smuggling; the myriad strands of the developing EU law and policy on irregular migration, such as the adoption of readmission agreements, and the relationship of this law and policy to external border controls in the context of EU enlargement and other non-legal means of EU decision-making; the contributions of international and non-governmental actors to charting a rights-based approach to irregular migration; and the problems these vulnerable persons face while resident in host countries, such as discrimination and denial of access to social rights and public services, which is inextricably bound up with their irregular status.
