Inspired by architecture, he articulates a pattern language of politics-a set of thirty-five design criteria for constructing sane and humane polity. Since ancient times, human beings have asked a fundamental question: What is a good society, and how should it be governed? Plato's response was philosophical. In *The Republic*, he searched for an abstract notion of justice to guide political thought and action. Aristotle's response was empirical. In *The Politics*, he tried to discover which constitutions were more conducive to justice in practice. Following Aristotle, the modern era embraced constitutionalism as the royal road to political nirvana. Thus the American founders, who were also inspired by the mechanical worldview, framed a constitutional machine intended to foster individual liberty and the pursuit of happiness. But the mechanical worldview is no longer intellectually tenable, and constitutional governance is no longer practically viable. Far from fostering a society in which men and women flourish according to their own lights, modern polities grow steadily more dysfunctional and oppressive. Ophuls argues that a pattern language best accords with the dawning ecological worldview and the emerging scientific understanding of systems and chaos. He contends that the proper way to shape the political future is not with rigid legal machinery, as is our wont, but instead with flexible design criteria resembling the architectural patterns used for constructing human settlements and dwellings.

Book excerpt: Without the Byzantine Empire, there never would have been Western civilization. Western civilization is generally regarded as the child of Athens, Jerusalem, and Rome. That is, in the West, our philosophical and political thought is derived from that of the ancient Greeks; our Christian religion comes from the Jewish religion, and both of these came to us via the Roman Empire and the civilization and culture it created. Western society has other forefathers as well: we would be unwise to give the Byzantine Empire short shrift. The ways in which it has influenced our world for the good, and indeed, created the parameters of our society at its healthiest and strongest, are insufficiently appreciated today. In its confusion, uncertainty, and lack of direction, the West has lost its way. There is a great deal it can, and should, learn from Byzantium. If the United States were to last as long as the Roman Empire, including its Byzantine period, it would have to continue as an independent country, with political and cultural continuity, until the year 2899. To maintain a unified nation state for over eleven hundred years is a remarkable achievement by any standard, and the Romans accomplished it while facing existential threats and efforts to extinguish their polity during virtually every period of their existence. Now, nearly six hundred years after the demise of the empire, its influence still resonates in a number of fields, albeit almost entirely unnoticed and unappreciated. There is no arguing with success. It’s time we took notice.

Mark Canuel argues that Romantic writers in Great Britain led one of the earliest assaults on the death penalty and were instrumental in bringing about penal-law reforms. He demonstrates how writers like Percy Bysshe Shelley, Lord Byron, William Wordsworth, and Jane Austen defined the fundamental contradictions that continue to inform today's debates about capital punishment. Celebrated reformers like Sir Samuel Romilly and William Ewart campaigned against the widespread use of death to punish crimes ranging from murder to petty theft, but they were most influential for initiating a system of penalties built upon conflicting motivations and justifications. Canuel examines the ways Romantic poets and novelists magnified these tensions while treating them as uniquely aesthetic opportunities, seized upon contending rationales of punishment to express imaginative power, and revealed how the imagination fueled the new penal code's disturbing vitality. Death-penalty reform, Canuel argues, in fact emerged from a new way of thinking about punishment as a negotiation among rationales rather than a seamless whole, with leniency and severity constantly at odds. He concludes by exploring how Romantic penal reform continues to influence contemporary views about the justice--and injustice--of legal sanctions.
