Una guida pratica sempre aggiornata con le ultime disposizioni di legge destinata a tutti i preposti, datori di lavoro e dirigenti che sono quotidianamente alle prese con i problemi relativi alla sicurezza, nei quali si muovono nuovi approcci al rischio (es. estero) e nuove modalità lavorative (es. smart working). Partendo da una premessa fondamentale: il D.Lgs. 81/2008 e s.m.i. ed il sistema prevenzionistico che da esso ha preso nuova forma (es. Provvedimenti attuativi del D.Lgs. 81/2008, quale il D.I. 22/01/2019 “nuovo decreto segnaletica”) non è un sistema di divieti, bensì un sistema di governo di tutte le attività lavorative per ridurre al minimo i rischi e che include il necessario corollario di controlli, vigilanza e sanzioni. L’evento lesivo, sia della salute (la malattia, ivi incluso lo stress), sia della sicurezza (l’infortunio), sia della dignità (il disagio lavorativo, ad esempio), si può sempre realizzare dal momento che è strettamente connesso all’impiego delle risorse umane. Ma solo se si saranno rispettate tutte le norme destinate alla minimizzazione del rischio tali eventi saranno seriamente limitati e, ove si verificassero, non vi sarà responsabilità di preposti, datori di lavoro, dirigenti e committenti sia con riferimento alle risorse interne che ai fornitori. Di qui l’importanza di questa guida che non solo offre un quadro dettagliato e sempre aggiornato della normativa in vigore, ma spiega in che modo assolvere ai compiti previsti dalla legge per evitare le pesanti sanzioni previste in caso di inadempienza.
