Available in PDF, EPUB and Kindle. Book excerpt: LANG AND MORGAN'S ESTATE AGENCY LAW AND PRACTICE NSW is a well-established guide to the regulations that surround the practice and licensing of an estate agent in NSW. It also provides a clear and practical guide to the role of the estate agent in the conveyancing process. In its first new edition since 1994, the sixth edition maintains and expands its detailed treatment of estate agency law and practice by updating legislation and case law. In particular, the new edition provides a detailed examination of the Property Stock and Business Agents Act 2002 , including an examination of the role of the Office of Fair Trading in issuing licenses, compliance and discipline of agents under the Act. The new edition also discusses the Rules of Conduct applicable to agents under the Property Stock and Business Agents Regulation 2003 and provides a timely overview of current conveyancing practices using the 2005 Contract for Sale of Land published by the Law Society of NSW and the Real Estate Institute of NSW. This book is an invaluable reference tool for all real estate agents, those involved in land transactions and students of agency, tenancy or property practice.

Book Sale of Land in NSW

Download or read book Sale of Land in NSW written by Patricia Lane and published by . This book was released on 2018-04-03 with total page 750 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sale of Land in NSW: Commentary and Materials Sixth Edition analyses the effects of the 2017 standard form of contract for sale of land and the Conveyancing (Sale of Land) Regulation 2017 (NSW) on Conveyancing law and practice. The plain English style, carefully selected extracts and concise approach ensures readers gain a sound working knowledge of the fundamental legal principles of vendor and purchaser law. In the time since the last edition of this book, the law and practice of conveyancing has had to adapt to deal with the changing legal and regulatory environment. There have been three editions of the Standard From Contract in the last three years to deal with the introduction of electronic conveyancing and capital gains withholding for foreign residents, and further increases in the number and type of regulatory matters that affect the quality of land, including the requirement for warnings and vendor disclosure. The intent of this book is still to provide students with a sound introduction to the fundamental concepts of conveyancing law and practice; and to provide practitioners with a first point of reference from which to commence their research. We have sought in this edition to provide some comparative material on aspects of the law of conveyancing in other Australian jurisdictions. One thing that has stood out in preparing this edition has been the variety of standard form contracts in the Australian States and Territories and the extent of differences, both great and subtle, in their legislative regimes. It has not been possible to adopt a systematic review of those regimes, but where possible we have provided references to interstate statutes, or a short comparative commentary. The primary subject of the book, though, is the law of New South Wales. There have not been quite so many new decisions to extract as in the previous edition, but the interaction of principles of property, contract and equity has produced decisions on several practical aspects, such as the implications of providing settlement statements, and the relationship between the purchaser's obligation to submit a transfer and the vendor's obligation to convey

Book Comparative Housing Sales and Purchase Agreements Under the Malaysia Singapore and New South Wales Housing Laws UUM Press

Download or read book Comparative Housing Sales and Purchase Agreements Under the Malaysia Singapore and New South Wales Housing Laws UUM Press written by Nuarrual Hilal Md. Dahlan and published by UUM Press. This book was released on 2011-01-01 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abandoned housing projects is one the major problems in housing industry in Peninsular Malaysia. The reasons leading to this problem are many. This catastrophe has caused multifarious problems to the stakeholders, particularly the purchasers who become the aggrieved parties. To date, there is no effective and once-and-for-all means to face the problems of abandoned housing projects. One of the factors which causes abandonment of housing projects in Peninsular Malaysia, is the lack of political will on part of the government to adopt an affirmative better housing delivery system such as the ‘full build then sell system’ and the introduction of a housing development insurance to face the problems of housing abandonment. This book provides in-depth analyses of the terms and conditions of the statutory standard sale and purchase agreements as enshrined in Schedules G, H, I and J of the Housing Development (Control and Licensing) Regulations 1989. The objective of this book, among others, is to identify the weaknesses of the terms of the agreements, if any, which may have contributed to the problem of abandoned housing projects and their consequential troubles. As comparative analyses, the terms and conditions of the sale and purchase agreements as applicable and enforced in the Republic of Singapore and New South Wales, Australia, are chosen. The purpose of these comparative analyses is to find the terms and conditions in these foreign jurisdictions’ agreements which can be learned and adopted in the statutory standard sale and purchase agreements (Schedules G, H, I and J). It is also for the betterment of the Malaysian housing industry as a whole, and to protect the interests of the stakeholders, in particular the purchasers as against the problems of housing abandonment and its consequences.
