In the lead up to the introduction of these new regulations there was a lot of speculation and media hype from the Trade Union movement which itimitated that the regulations were not enough and that the move to a more performance based style of legislation was going to mean that more workers in Victorian workplaces were going to be injured and killed. This paper will review those regulations with the emphasis on certification requirements for forklift truck operators and the issues management need to consider to ensure not only compliance with the regulations but also to fulfill their duty of care and work towards having and maintaining a safe work environment for its employees. In this paper a review of current Victorian studies relating to forklift related injuries and fatalities highlighted the significance of the forklift truck to not only the operator but also to nearby pedestrians, the need for management training and awareness and the general lack of information available due to data collection systems. The author concludes that the Victorian Plant package introduced by the Victorian Government in 1994 will allow more flexibility for both employers and employees to work together to provide, maintain and enjoy a safe place of work. There is no available evidence to suggest that injuries and fatalities due to forklift operation has at this time increased as a result of deregulation. " -- Abstract.
