Among the most compelling yet controversial forms of legal protection for workers is the right to refuse unsafe work. The rise of globalization, precarious work, neoliberal politics, attacks on unions, and the idea of individual employment rights have challenged the protection of occupational health and safety for workers worldwide. In Hazard or Hardship, Jeffrey Hilgert presents the protection of refusal rights as a moral and a human rights question. Hilgert finds that the protection of the right to refuse unsafe work, as constituted under international labor standards, is a failure and calls for a reexamination of worker health and safety policy from the ground up. The current model of protection follows an individual employment rights framework, which fails to protect workers against the inherent social inequalities within the employment relationship. To adequately protect the right to refuse as a human right, both in North America and around the world, Hilgert argues that a broader protection must be granted under a freedom of association framework. How to instigate and implement the needed reform is a timely issue that is currently being debated. Reforming the Workplace is an account of a successful program that is now a model for nationwide improvements in various regulatory agencies. Joseph Rees's focus is the Occupational Safety and Health Administration (OSHA), which in 1982 announced a major shift in policy, from strict government regulation to self-regulation by industries with proven safety records. In California, this resulted in the Cooperative Compliance Program (CCP), an arrangement among labor unions, management, and California OSHA that became responsible for overseeing safety regulations at seven large construction sites throughout the state. In his detailed study of the CCP, Joseph Rees provides important empirical data and assesses the reasons the program succeeded. That success is so important, he demonstrates, because the CCP represents a different approach to reform, self-regulation, that can be extended to and tailored for many troubled agencies. Reforming the Workplace is a comprehensive study that will be a valuable resource for scholars and students of law and social policy in general, and of federal regulation policies in particular.

Book excerpt: In business in general, and construction in particular, a battle has long been waged over job safety, and whether or not unions have a beneficial effect in the area of workplace safety. One recent study has even indicated that, contrary to the claims of organized labor, union job sites have higher fatality rates than non-union sites. Our research used different indicators to assess job safety in construction. We utilized nearly 3,000 inspections by OSHA, from 1989 to 1994, to determine whether in fact there were safety differences between union and non-union construction firms. Results indicated that on three major dimensions-lost workday injuries, total violations, and percentage of serious violations -union firms had fewer incidences than non-union organizations. These findings are discussed within the context of project management.
