Book excerpt: Voices in the Legal Archives in the French Colonial World: "The King is Listening" offers, through the contribution of thirteen original chapters, a sustained analysis of judicial practices and litigation during the first era of French overseas expansion. The overall goal of this volume is to elaborate a more sophisticated "social history of colonialism" by focusing largely on the eighteenth century, extending roughly from 1700 until the conclusion of the Age of Revolutions in the 1830s. By critically examining legal practices and litigation in the French colonial world, in both its Atlantic and Oceanic extensions, this volume of essays has sought to interrogate the naturalized equation between law and empire, an idea premised on the idea of law as a set of doctrines and codified procedures originating in the metropolis and then transmitted to the colonies. This book advances new approaches and methods in writing a history of the French empire, one which views state authority as more unstable and contested. Voices in the Legal Archives proposes to remedy the under-theorized state of France’s first colonial empire, as opposed to its post-1830 imperial expressions empire, which have garnered far more scholarly attention. This book will appeal to scholars of French history and the comparative history of European empires and colonialism.

Book excerpt: Samuel Beckett, whose play Waiting for Godot was one of the most influential works for the post-World War II generation, has long been identified with the debilitated and impotent characters he created. In this provocative book, Lois Gordon offers a new perspective on Beckett, challenging the prevalent image of him as reclusive, self-absorbed, and disturbed. Gordon investigates the first forty years of Beckett's life and finds that he was, on the contrary, a kind and generous man who responded sensitively and even heroically to the world around him. Gordon describes the various places and events that affected Beckett during this formative period: war-torn Dublin during the Easter Uprising and World War I, where he spent his childhood and student days; Belfast and Paris in the 1920s and London during the Depression, where he lived and worked; Germany in 1937, where he traveled and witnessed Hitler's brutal domestic policies; prewar and occupied France, where he was active in the Resistance (for which he was later decorated); and the war-ravaged town of Saint-L� in Normandy, which he helped to restore following the liberation. Gordon also portrays the individuals who were important to Beckett, including Jack B. Yeats, Alfred P�ron, Thomas McGreevy, and, most significantly, James Joyce, who was a model for Beckett personally, artistically, and politically. Gordon argues convincingly that Beckett was very much aware of the political and cultural turmoil of this period and that the enormously creative works he wrote after World War II can, in fact, be viewed as a product of and testament to those tumultuous times.

It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.
