This raises the question of whether we’re currently witnessing a drive towards greater coherence or more divergence in agreements on trade in services.

Andean leaders copied the institutional and treaty design of the European Community, and in the 1970s, member states decided to add a tribunal, again turning to the European Community as its model. Since its first ruling in 1987, the Andean Tribunal of Justice has exercised authority over the countries which are members of the Andean Community: Bolivia, Colombia, Ecuador, and Peru (formerly also Venezuela). It is now the third most active international court in the world, used by governments and private actors to protect their rights and interests in the region. This book investigates how a region with weak legal institutions developed an effective international rule of law, why the Tribunal was able to induce widespread respect for Andean intellectual property rules but not other areas governed by regional integration rules, and what the Tribunal's experience means for comparable international courts. It also assesses the Andean experience in order to reconsider the European Community system, exploring why the law and politics of integration in Europe and the Andes followed different trajectories. It finally provides a detailed analysis of the key factors associated with effective supranational adjudication. Third, a reinvigorated trade strategy for the Fund would help country authorities to address key challenges, including adjusting to structural changes associated with climate change and new technologies; promoting policy coherence between trade and non-trade objectives such as climate, inequality, and security; and managing rising geopolitical tensions and risks of geo-economic fragmentation.

The introduction notes that judging by the experience of Cancun (2003) and the recent Hong Kong Ministerial (2005), developing countries are fast emerging as quick learners of the rules of the game, but need to sharpen those skills further: "It is quite prudent to understand that hidden from public glare, both the battle and the war will now continue in Geneva, which is less of a free trade bastion than Hong Kong. It is by now a time-honoured fact that the intensity of liberalisation undertaken at home makes handling the WTO-induced reforms easier, and the priorities for Indian policy makers are therefore, obvious. Notwithstanding the WTO objective, even eleven years after the inception of the multilateral body, the trade barriers, both in developed and developing countries are quite significant and unilateral liberalisation is not easily forthcoming. Although this lack of market access hurt the developing countries much more severely than their developed counterparts, the former group never systematically bargained at the negotiating table with the latter before the Doha Ministerial (2001). Looking at the negotiating strategies of India and several other WTO members over the years, the nine papers in this volume explore the current negotiating scenario and the concerns for India and other developing countries. While some papers attempt to chalk out the future of global free trade and the determinants of protectionism of major players, the other ones look into the future of India's sectoral negotiating strategy.
