The shared Nordic values of democracy, rule of law and trust between citizens and authorities, should be carried further into the digital age. Therefore, the Nordic Council of Ministers has initiated a pilot project that identify relevant themes and initiatives on the basis of input and information from public authorities and supervisory bodies in Norway, Sweden, The Faeroe Islands, Finland and Denmark. The team behind the report assesses that there is a need to: - strengthen the exchange of knowledge regarding investigations, reflections and case law of supervisory bodies in the Nordic and Baltic countries - identify and analyse the legal framework related to constitutional law and human rights for public sector digitisation, and to evaluate whether present administrative law provides sufficient support for compliance within these parameters - study the effects of digitisation on governance, control and liability structures in the field of public administration, possibly including the court administration - investigate the direction of the legislative development, clarify the underlying considerations and interests and assess this development in light of the values of legal certainty and rule of law - integrate legal research as an element of projects related to public digitisation within Nordic research programmes The Nordic Council of Ministers will now consider how it can support using the opportunities offered by digitisation so that they safeguard the shared Nordic values.

By gathering contributions from scholars who are experts in their respective fields of legal research, it demonstrates that AI regulation is not a specialized sub-discipline, but affects the entire legal system and thus concerns all lawyers. Machine learning-based technology, which lies at the heart of what is commonly referred to as AI, is increasingly being employed to make policy and business decisions with broad social impacts, and therefore runs the risk of causing wide-scale damage. At the same time, AI technology is becoming more and more complex and difficult to understand, making it harder to determine whether or not it is being used in accordance with the law. In light of this situation, even tech enthusiasts are calling for stricter regulation of AI. Legislators, too, are stepping in and have begun to pass AI laws, including the prohibition of automated decision-making systems in Article 22 of the General Data Protection Regulation, the New York City AI transparency bill, and the 2017 amendments to the German Cartel Act and German Administrative Procedure Act. While the belief that something needs to be done is widely shared, there is far less clarity about what exactly can or should be done, or what effective regulation might look like. The book is divided into two major parts, the first of which focuses on features common to most AI systems, and explores how they relate to the legal framework for data-driven technologies, which already exists in the form of (national and supra-national) constitutional law, EU data protection and competition law, and anti-discrimination law. In the second part, the book examines in detail a number of relevant sectors in which AI is increasingly shaping decision-making processes, ranging from the notorious social media and the legal, financial and healthcare industries, to fields like law enforcement and tax law, in which we can observe how regulation by AI is becoming a reality.

On one level, any programme of inculcating positive dimensions of free speech might be understood as inherently polycentric and hence political in character. Yet, a number of jurisdictions evince enhanced legal recognition for the principle. The economy has demonstrated remarkable resilience during this period, supported by policy measures commensurate with the magnitude of the challenge, like the USD 2 billion fiscal response to the pandemic. These shocks have also exposed key underlying vulnerabilities in the country’s economy and development model, including reliance on agricultural exports, informality, limited revenue-raising capacity, and exposure to the consequences of climate change. The response and stimulus recognised these issues and found new ways to address or circumvent them, albeit in many cases not efficiently or permanently. This report draws lessons from policy measures implemented during the pandemic and recovery phase and applies them to current strategic challenges. In doing so, it highlights policy priorities to make Paraguay’s development path more inclusive, stronger and more resilient.
