Unlike in other works, these areas of activity are not viewed as isolated spheres where citizens could act independently from political and societal constraints. They are rather conceptualized here as geographical, social or institutional spaces whose existence was either outside of political control or more or less intentionally allowed by authorities and other decision-makers. The contributions investigate how East Germans, Poles, Romanians, Slovaks and Czechs coped with the limitations of socialist reality. How did they adopt and successfully adapt given norms to their own specific interests? To what extent were the resulting "rooms for manoeuvre" not only essential aspects of the state socialist system, but even necessary to stabilize it?

From a legal point of view, however, it makes quite a difference to the position of the court whether lawfinding or lawmaking is meant. Why write a book about lawmaking by the courts just in the area of administrative law? In administrative law, the administration is positioned between the legislature and the judiciary. The courts review decisions taken by the administration in implementing the law; however, where the administration has often been granted a degree of discretion, the courts access the lawfulness of the decision. The relation administration-judiciary raises so many specific questions that it justifies a book on judicial lawmaking in administrative matters. The authors are all members of the research program Public Law of the Ius Commune School.

Since the mid-1990s, historical research has intensively discussed the role played by private, domestic and foreign enterprises during the ‘Third Reich’. Numerous case studies suggest that even under the extreme ideological circumstances of the ‘Third Reich’, the strategic decisions of private firms followed economic criteria. In fact, the regime was especially able to control the economy successfully in those cases in which it operated with economic incentives and gave companies room for manoeuvre. This scope, however, became increasingly smaller towards the end of the war due to increasing state intervention and government control. The chapters discuss this scope of action and relate it to the National Socialist crimes. This book was originally published as a special issue of Business History.
