  • Author : Cary Federman
  • Publisher : University of Michigan Press

Download or read book Democracy and Deliberation written by Cary Federman and published by University of Michigan Press. This book was released on 2021-06-15 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sex offender laws include residency restrictions, registration and notification requirements, and post-conviction civil commitment. These laws and regulations impose serious restrictions on the movements of convicted sex offenders. This is controversial because these laws and regulations occur after the sex offender has completed his time in prison. These laws and regulations are intended to have both a deterrent and therapeutic effect. Residency restrictions seek to prevent sex offenders from recommitting their crimes and civil commitment provides psychological services while incarcerated in a forensic facility. Most works on this subject are deeply critical of these laws. Cary Federman takes a more sympathetic approach to sex offender legislation. He focuses on the deliberative intentions of legislators, exploring the limits of judicial review and the rights of interested parties to influence lawmaking. Leaders of these interested parties are usually the parents of children who have been sexually violated and murdered. Critics of sex offender legislation tend to focus on the convicted parties, arguing that their rights have been violated. Democracy and Deliberation asserts that these laws are expressions of the deliberative intentions of lawmakers concerned about public safety—they are thus constitutional, if not always wise.

Book The Law Officer s Pocket Manual

Download or read book The Law Officer s Pocket Manual written by John G. Miles Jr. and published by Routledge. This book was released on 2022-01-31 with total page 107 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law Officer’s Pocket Manual is a handy, pocket-sized, spiral-bound manual that highlights basic legal rules for quick reference and offers examples showing how those rules are applied. The manual provides concise guidance based on U.S. Supreme Court rulings on constitutional law issues and other legal developments, covering arrest, search, surveillance, and other routine as well as sensitive areas of law enforcement. It includes more than 100 examples drawn from leading cases to provide guidance on how to act in a wide variety of situations. Some new material in the 2022 Edition: In a unanimous ruling, the U.S. Supreme Court curbed warrantless home entries. The court said that police can’t automatically pursue fleeing misdemeanor suspects into a residence without a warrant. Whether exigent circumstances exist depends on the particular facts of each case. In another case, the high court ruled that when a police officer applies force to a suspect’s body with intent to restrain, this is a seizure under the Fourth Amendment. The Supreme Court, in a unanimous ruling, bolstered home protections. It ruled that the community caretaking exception to the Fourth Amendment’s warrant requirement doesn’t extend to the home. The U.S. Supreme Court, in a unanimous decision, untangled some jurisdictional issues involving Native American, state, and federal enforcement officials. The court bolstered the authority of tribal police over non-American Indians traveling on public roads through reservations. In a pair of cases, the Court reinforced the court-made doctrine of qualified immunity. In both cases the high court said the law was not so "clearly established" as to allow litigation against the officers to move forward. In a civil rights case, the court sent the case back to the circuit court to determine if the suit can move forward.

Book Constitutional Law for Criminal Justice

Download or read book Constitutional Law for Criminal Justice written by Jacqueline R. Kanovitz and published by Routledge. This book was released on 2015-02-11 with total page 903 pages. Available in PDF, EPUB and Kindle. Book excerpt: Criminal justice professionals often do not receive the training they need to recognize the constitutional principles that apply to their daily work. Constitutional Law for Criminal Justice offers a way to solve this problem by providing a comprehensive, well-organized, and up-to-date analysis of constitutional issues that affect criminal justice professionals. Chapter 1 summarizes the organization and content of the Constitution, the Bill of Rights, and the Fourteenth Amendment. The next eight chapters cover the constitutional principles that regulate investigatory detentions, traffic stops, arrests, use of force, search and seizure, technologically assisted surveillance, the Wiretap Act, interrogations and confessions, self-incrimination, witness identification procedures, the right to counsel, procedural safeguards during criminal trials, First Amendment issues relevant to law enforcement, capital punishment, and much more. The final chapter covers the constitutional rights of criminal justice professionals in the workplace, their protection under Title VII of the Civil Rights Act, and their accountability under 42 U.S.C. § 1983 for violating the constitutional rights of others. Part II contains abstracts of key judicial decisions exemplifying how the doctrines covered in earlier chapters are being applied by the courts. The combination of text and cases creates flexibility in structuring class time. Constitutional Law for Criminal Justice makes complex concepts accessible to students in all levels of criminal justice education. The chapters begin with an outline and end with a summary. Key Terms and Concepts are defined in the Glossary. Tables, figures, and charts are used to synthesize and simplify information. The result is an incomparably clear, student-friendly textbook that has remained a leader in criminal justice education for more than 45 years.
