Book excerpt: Over the last hundred years, pregnancy and childbirth has become increasingly safe – yet it is still a site of risk, and a contested ground on which health professionals and pregnant women both face high costs of error. In this context, all those involved in managing pregnancy and birth are expected to identify and mitigate risk: pregnant women are subject to increasing surveillance to ensure the safety of the unborn foetus, and every aspect of childbearing is increasingly medicalised. This publication brings together fascinating social science research to explore the ways in which risk is both created and managed in pregnancy and childbirth. The introductory chapters reflect on the changing social context of childbirth, in particular the medicalisation of both pregnancy and childbirth with development of specialist practitioners, such as obstetricians and midwives who claim to have the knowledge, technology and skills to identify and manage the risks involved. The next three chapters that examine the ways in which women’s behaviour during pregnancy is constructed as potentially risky -- for example smoking, drinking alcohol and taking drugs, and how these risks are monitored and mitigated. The final two parts of the book address the construction of and responses to both medicalisation and risk in childbirth. Altogether, it represents a valuable insight into the complex world of pregnancy, childbirth and risk. This book brings together editorials and articles originally published in special and open issues of Health, Risk and Society.

The present work systematically examines these two important prerequisites for tortious liability under the combined heading of ‘misconduct’. Unlike current textbooks, national casebooks and monographs, it builds on the experiences gathered in the national legal systems over the past decades and thereby fills a major gap which still exists today. It thus does what the previous volumes in the ‘Digest of European Tort Law’ series did for other key elements of tort law, namely natural causation and damage. Once again, the publication contains a selection of the most important cases from 28 states across Europe as well as cases handed down by European Union courts; it also highlights cases from earlier periods of legal history. For each case, the facts and the relevant court decision are presented and these are then accompanied by an analytical commentary. In addition, the editors provide comparative analyses of the cases reported and a special report is dedicated to how key decisions would be resolved under model European rules on tort law. The editors believe that the material gathered here may provide guidance for an organic convergence of the national legal systems in Europe. It constitutes the basis of an acquis commun that is infinitely richer (though also much more complex) than the rather bland and abstract concepts contained in national codifications, European legislation and modern model rules.

Considered the "natural" continuity of childbirth without intervention, breastfeeding is a fundamental component of the holistic, continuous and individualised care independent midwives provide as they engage with parents in a shared construction of meaning around breastfeeding. This book offers new perspectives on the conceptualisation of breastfeeding as a shared process. Parents, in collaboration with their midwife and baby, are jointly constructing "negotiated breastfeeding". As the child grows and develops, questions arise regarding the management of risks, the construction of the lactating body and the body work required, and the perception of breastfeeding as a means of communication with the child, consistent with a "child-centred" approach to parenting. Fostering a reflection on the contrasts and similarities between the marginal model of holistic care and the dominant biomedical model, this book sheds light on issues of a broader scope: the relationship to health risks and health promotion, gender inequalities regarding parental roles and responsibilities, the concept of the child as a "project", and the consequential "intensification" of parenthood. The book also explores transversal themes by outlining how reproduction and parenting are undertaken in Switzerland, framed by the local cultural, political and economic context, including the gender system and resulting power relationships.

Book excerpt: Object of fascination and fantasy, the female body can be idealized, reified or shrouded. “It is we who make women what they are worth and that is why they are worthless”, proclaimed Mirabeau in the days of the Enlightenment, to which Aragon later replied: “Woman is the future of Man”. The ambiguities of the female body are therein exposed. This work examines the relationship between the female body and biomedicine. Many possibilities are offered to women through biomedical techniques: from assistance to procreate (with assisted reproduction) to refusal to do so (contraception, voluntary sterilization, termination of pregnancy); to be informed of genetic predispositions (through the use of available genetic tests); or to improve their physical appearance with cosmetic surgery. But a recurrent question arises: with its rapid progress and its extreme medicalization of the body, can biomedicine liberate women? Or rather, given the risks of the commodification of the body or its parts, is it not a source of exploitation ? The authors of this work, jurists, anthropologists, philosophers, sociologists and doctors, have explored these questions. The contributions from nineteen countries in this international multidisciplinary study analyse the reality of the amazing developments of biomedicine on the female body. Numerous systems are compared for the first time; European, African, North and South American, but also Chinese and Japanese. Beyond highlighting differences, and identifying similarities in the development of “enhancement medicine”, the objective of this work is ultimately to show the complexity surrounding the question of a woman’s freedom over her body and the extent to which this is limited by the State.

Ces données montrent l'importance du champ de la contractualisation que ce livre parcoure en offrant aux lecteurs une double entrée : par la démarche et par les acteurs. Les deux premières parties sont consacrées à la présentation des concepts mais aussi des outils et des processus permettant la conception et la mise en œuvre d'une politique de contractualisation. La troisième partie détaille, pour chaque type d'acteurs, les possibilités apportées par la démarche contractuelle. Une dernière partie apporte la contribution de différentes approches pour analyser la contractualisation. Le message principal de cet ouvrage est que la contractualisation, lorsqu'elle est correctement utilisée, peut être un outil efficace pour améliorer la performance des systèmes de santé. Si la démarche contractuelle est applicable dans tous les pays, les auteurs accordent une importance particulière à la situation des pays en développement où la faiblesse des ressources et de la gouvernance donne une teneur particulière aux recommandations qui peuvent être faites.
