The public sector is the biggest single producer and holder of information including administrative and government documents, regulatory texts, political data and public registers. The authors demonstrate that this huge store of information is a key resource for a broad range of stakeholders such as citizens, civic organisations, private businesses and public sector agencies. They argue that charging the marginal cost of dissemination, a policy favoured in the US, will lead to optimal economic growth in society and will far outweigh the immediate perceived benefits of aggressive cost recovery.

It impacts the kinds of policy choices that can be expected to be effective in stimulating commercial and non-commercial re-use of public sector information by private actors (businesses, civil society organizations, individual citizens, etc.). This paper presents the Recommendations of the LAPSI Working Group on Constitutional, Human Rights and Environmental Perspectives. We assess in more detail the relationship between the PSI Directive and (statutory) rights of access and duties to disclose information under national laws and European law. EU re-use policies and instruments must enable public sector bodies in Member States to work within their existing access infrastructure, in terms of local divisions of competences, procedures and control over pro-active dissemination of information. If the requirements imposed under EU re-use law do not align with local freedom of information laws, it may produce a negative effect on transparency. Not only that, it may also adversely affect conditions for fostering (commercial) re-use. This paper was drafted within the WG6 - Constitutional, Human Rights and Environmental Perspectives of the European Thematic Network LAPSI (Legal Aspects of Public Sector Information website).

This book is the culmination of nearly six years of research initiated by Fred Cate and Jim Dempsey to examine national practices and laws regarding systematic government access to personal information held by private-sector companies. Leading an effort sponsored by The Privacy Projects, they commissioned a series of country reports, asking national experts to uncover what they could about government demands on telecommunications providers and other private-sector companies to disclose bulk information about their customers. Their initial research found disturbing indications of systematic access in countries around the world. These data collection programs, often undertaken in the name of national security, were cloaked in secrecy and largely immune from oversight, posing serious threats to personal privacy. After the Snowden leaks confirmed these initial findings, the project morphed into something more ambitious: an effort to explore what should be the rules for government access to private-sector data, and how companies should respond to government demands for access. This book contains twelve updated country reports plus eleven analytic chapters that present descriptive and normative frameworks for assessing national surveillance laws, survey evolving international law and human rights principles applicable to government surveillance, and describe oversight mechanisms. It also explores the concept of accountability and the role of encryption in shaping the surveillance debate. Cate and Dempsey conclude by offering recommendations for both governments and industry.

In particular, the democratic and economic foundations of current regimes applicable to Public Sector Information [PSI] will be examined and compared. Specifically, the legal title claimed by Public Bodies for applying terms and conditions of use upon the information they detain will be examined. The foundations of the copyright and sui generis rights which are usually deemed to apply on PSI will be evaluated considering other concurring interests on PSI. This examination will contribute to offer an assessment on whether current legal schemes are over-balanced in favour of Intellectual Property Rights [IPR], safeguard all interests insisting on such information and in any case are necessary to fulfill the goals for creating and disseminating PSI in an efficient and sustainable way. To achieve this, the present paper will investigate the compatibility of copyright ownership on PSI with the traditional justifications of IPRs and subsequently explore alternative protection schemes for PSI which are neutral to access to and freedom of information rights.

Book excerpt: While governments throughout the world have different approaches to how they make their public sector information (PSI) available and the terms under which the information may be reused, there appears to be a broad recognition of the importance of digital networks and PSI to the economy and to society. However, despite the huge investments in PSI and the even larger estimated effects, surprisingly little is known about the costs and benefits of different information policies on the information society and the knowledge economy. By understanding the strengths and weaknesses of the current assessment methods and their underlying criteria, it should be possible to improve and apply such tools to help rationalize the policies and to clarify the role of the internet in disseminating PSI. This in turn can help promote the efficiency and effectiveness of PSI investments and management, and to improve their downstream economic and social results. The workshop that is summarized in this volume was intended to review the state of the art in assessment methods and to improve the understanding of what is known and what needs to be known about the effects of PSI activities.
