In questo breve trattato Beccaria si pone con spirito illuminista delle domande circa i delitti e le pene allora in uso. L'opera, stampata per la prima volta a Livorno da Marco Coltellini, incontrò un notevole successo ed ebbe vasta eco in tutta Europa. Fu apprezzata nella Milano illuminista, fu vista come il prodotto dell'attività innovatrice in Francia e messa subito in pratica dalla zarina Caterina II di Russia. L'opera fu scritta in francese, poiché in questo periodo era forte l'egemonia della Francia e le persone di cultura parlavano e scrivevano in francese con naturalezza, anche se di diversa nazionalità.
