Book excerpt: Dans le cadre du projet " Compendium de Droit de la Consommation", la Commission européenne a commandé une analyse comparative sur la manière dont les huit directives concernées par la révision de l'acquis communautaire sont transposées par les Etats membres, y compris par la jurisprudence et les pratiques administratives. Cette analyse a été publiée sur le site Internet de la Commission européenne en décembre 2006. L'analyse met en lumière l'incohérence des huit directives entre elles, mais également le fait que leur transposition a été réalisée de manière très différente dans les 25 Etats membres étudiés. Les résultats essentiels de l'analyse, qui ont été résumés et qui figurent dans le tableau ci-après, suivent le plan adopté par le Livre vert sur la révision de l'acquis communautaire en matière de protection des consommateurs. Du fait de l'adhésion au 1er janvier 2007 de la Bulgarie et de la Roumanie, l'analyse n'a pas été encore menée à son terme pour ces Etats. Toutefois et jusqu'à présent, la Bulgarie a transposé les Directives 85/577, 93/13, 94/47, 97/7, 98/6, 98/27 et 99/44 dans son Code de la Consommation du 9.12.2005. La Directive 90/314 a été transposée dans une loi spécifique. La Roumanie a, quant à elle, transposé les huit directives précitées par l'adoption de lois spécifiques, en empruntant la méthode du " copier-coller ". Les résultats de l'analyse comparative confirment indéniablement la nécessité de prendre des mesures législatives destinées tant à améliorer l'acquis en matière de protection des consommateurs, que la mise en place du marché intérieur. Pour ce faire et, comme il est démontré dans les conclusions, la meilleure méthode semble celle adoptée par la Commission européenne dans son Livre vert. Il s'agit d'adopter l'option en faveur d'un instrument horizontal, combinée le cas échéant, avec la modification des directives déjà existantes. Cette voie ne constitue assurément que le premier pas d'une démarche législative plus globale qui, pour être pleinement réussie, doit notamment emprunter les directions des règles de conflit de lois (Rome I) et du Droit européen des contrats (Cadre commun de Référence).

For many new fans of class actions, collective redress has become a Holy Grail of sorts, a miraculous tool that will rejuvenate national systems of civil justice and grant them unprecedented power. Still, while the introduction of various forms of representative action has virtually become a fashion, it is anything but certain that attempting to transplant American-style class action will be successful.
