Book excerpt: This report aims to provide insights into the development, since 2016, of the European Commission’s system of Expert Groups, including the Register of Expert Groups, thus updating the European Parliament’s study ‘Composition of the Commission’s expert groups and the status of the register of expert groups’ (September 2015). The Update finds that the European Commission’s revised Horizontal Rules, introduced in May 2016, triggered important improvements in terms of balance of interests, transparency and gender balance. Notwithstanding, there is further room for enhancing the system, and this Update recommends: further strengthening balance with a specific focus on the Expert Groups that continue to experience imbalance; further enhance transparency of Expert Group deliberations; remind Expert Groups about the requirement for gender balance; for the European Commission to report on the system and evaluate the system’s performance; and to conduct further research on specific types of Expert Group members and the use of Expert Groups.

Book excerpt: This study aims to provide insights into the development, since 2012, of the European Commission's system of Expert Groups, including the Register of Expert Groups. The specific focus of this study is an assessment of the European Commission's compliance with a set of European Parliament conditions attached to repeated European Parliament budget reserves for the Expert Group budget. The European Parliament conditions aim to strengthen the balanced representation of interests in the Expert Groups, address conflicts of interest, and ensure transparency, in terms of open access to the working and outputs of the Expert Groups. The study finds that the European Commission, despite some progress, continues to fall short of full compliance with the European Parliament conditions on balance and transparency. Based on this study's findings, it is considered that a more systematic approach to balance would help overcoming information asymmetries and contribute to throughput legitimacy. Enhanced transparency also has potential to enhance Expert Group outputs. This study therefore recommends a systematic approach to balance, the promotion of full transparency, more resources for Secretariat General oversight and enforcement, and the systematic evaluation of Expert Group performance at the level of the system of Expert Groups and for all individual Expert Groups.

Book excerpt: This is my submission to the European Ombudsman's public consultation on the composition of EU Commission expert groups conducted between May and August 2014. The comments concentrate on the unbalanced representation of interest groups, the inadequacy of safeguards for the selection and external monitoring of experts groups and their work (esp. in the area of intellectual property), and the institutional weaknesses and inertia that facilitate the ongoing expansion of lobby practices (e.g. MEPs, including Chairs of European Parliament's Committees can hold second jobs with corporations).It is observed that although a great number of EU projects are initiated and implemented in the name of small and medium size enterprises (SMEs), their representation is not reflected in the composition of expert groups. In addition, the current procedures for the selection of experts do not provide for effective safeguards to prevent or minimise conflicts of interests. Moving beyond the narrow scope of the European Ombudsman's consultation, it is stressed that for an effective monitoring system to exist the targeted area should cover all experts in the EU who influence legislative decisions and important development policies.

Book excerpt: Almost two decades ago, the fall of the Santer Commission against a background of allegations of maladministration and nepotism had the effect of placing accountability on the political agenda of the EU institutions. More recently, the non-ratification of the Constitutional Treaty, the difficulties of the ratification of the Lisbon Treaty and the current financial crisis have increased the calls for accountability in the EU. This book investigates whether any progress towards more accountability and transparency has been made in the post-Lisbon era by taking a holistic approach to the subject. Marios Costa argues that currently the EU institutions and the Member States are not in a position to hold the so-called independent agencies as well as the various committees and expert groups accountable. Despite recent progress, the EU still needs to put forward an acceptable constitutional framework which will truly secure accountability at the EU level of governance.

At a time when the very notion of expertise and expert advice is increasingly losing authority, the book addresses these challenges by empirically examining specific administrative processes and institutional designs in the European Union. The first part of the volume theorizes expertise and its contestation by examining accounts of the legitimate institutional design of knowledge production processes and exploring the theoretical links of Europeanisation and expertise. The second part of the book delves into empirical institutionalist accounts of expertise and maps the role of experts in a variety of EU institutions but also explains the implications when EU bodies themselves are in an ‘expert’ position, such as agencies. The book offers insights into how individual experts deal with the challenge of producing reports that will be heard by policy-makers, while at the same time preserving their independence. Broadening its scope, the book then expands the analysis to the role of advisory committees in light of the shift from a reliance primarily on in-house expertise to including more external experts in advisory groups in the European Commission and European Parliament as well as at the European External Action. In the third part, the book opens the lens to developments beyond the EU by taking into account two highly pertinent fields: climate change and trade. These fields are highly complex, fast-developing, and politicised issues, and the book engages with them in order to provide an outside-in perspective on expertise. The Forty-sixth WHO ECDD critically reviewed six new psychoactive substances: including two benzodiazepines (bromazolam, flubromazepam), one novel synthetic opioid (butonitazene), two cathinones/stimulants (3-CMC, dipentylone) and one dissociative-type substance (2-fluorodeschloroketamine). A critical review to consider international scheduling measures was undertaken for each substance so that the Expert Committee could consider whether information about these substances may justify the scheduling or a change in scheduling of a substance in the 1961 or 1971 Conventions. In addition, the Forty-sixth ECDD carried out a pre-review of nitrous oxide and carisoprodol to consider whether current information justified a critical review. This report summarizes the findings of the forty-sixth ECDD meeting.
