Book excerpt: The review considered six key counter-terrorism and security powers: (1) the detention of terrorist suspects before charge; (2) section 44 stop and search powers and the use of terrorism legislation in relation to photography; (3) the use of the Regulation of Investigatory Powers Act 2000 (RIPA) by local authorities and access to communications data more generally; (4) measures to deal with organisations that promote hatred or violence; (5) extending the use of 'Deportation with Assurances' in a manner that is consistent with our legal and human rights obligations; (6) control orders (including alternatives). The review concludes that some counter-terrorism and security powers are neither proportionate nor necessary. The key findings are: (i) a return to 14 days as the standard maximum pre-charge detention period; (ii) an end to the indiscriminate use of stop and search powers under section 44; (iii) the end to the use of the most intrusive RIPA powers by local authorities to investigate low level offences and applications by authorities to use RIPA techniques need a magistrate's approval; (iv) a commitment to rationalise the legal bases by which communications data can be acquired; (v) a stronger effort to deport foreign nationals involved in terrorist activities in this country fully respecting our human rights obligations; (vi) the end of control orders and their replacement with a fairer and more focused regime. Additional resources will be provided to the police and security agencies to ensure the new measures are effective not only in protecting the public but in facilitating prosecution.

The purpose of the review - carried out by the Office for Security and Counter Terrorism (OSCT) in the Home Office - was to determine whether it might be possible to roll some back some of the measures imposed by counter-terrorism and other legislation over the last decades whilst still providing protection for the UK's citizens. Lord Macdonald outlines the process of the review, noting that the OSCT surveyed a wide range of evidence, engaged with many interested parties and maintained a high degree of impartiality. His report then discusses the process whereby the review reached its conclusions on: pre-charge detention; terrorism stop and search section 44); photography and the use of counter-terrorism powers; the Regulation of Investigatory Powers Act and local authorities; access to communications data; groups that espouse or incite violence or hatred; deportations of foreign nationals engaged in terrorism; control orders. Lord Macdonald believes that the recommended reduction in pre-charge detention to 14 days, the repeal of section 44, the greater regulation of local authority surveillance and the outright removal of those aspects of control orders that most resemble house arrest, are all to be regarded as reforms of real significance. They point to an unmistakable re-balancing of public policy in favour of liberty.

The stated aim of the review "is to ensure that the powers and measures covered by the review are necessary, effective and proportionate and meet the UK's international and domestic human rights obligations". The review is to consider the following six powers: control orders (including alternatives); section 44 of the Terrorism Act 2000 regarding stop and search powers; the Regulation of Investigatory Powers Act 2000 and access to communications data more generally; extending the use of deportations with assurances; measures to deal with organisations that promote hatred or violence and the detention of terrorist suspects before charge. Amnesty International has long criticized the UK government for many of the practices it has adopted in the name of countering terrorism and protecting national security. A number of these practices are inconsistent with the UK's obligations under international human rights law and standards and a review into these powers is long overdue. The purpose of this submission is to outline Amnesty International's primary concerns in relation to four of the powers under consideration; the control orders regime; the use of diplomatic assurances in the context of national security deportations; the 28 day limit for pre-charge detention of people suspected of terrorism-related activity; and the use of stop and search powers under section 44 of the Terrorism Act 2000.

The Committee's conclusions are based on two key principles of an individual's right to liberty and privacy; and the need for public protection from terrorism. Conclusions drawn include that special counter-terrorism legislation should be kept distinct from general crime and security laws, and the provisions of the Act which are not specifically targeted at terrorism should be reconsidered. In particular, the powers allowing foreign nationals to be detained potentially indefinitely should be replaced as a matter of urgency. Measures related to tackling the financing of terrorism and targeting those who withhold information about terrorist offences are welcomed, but there is a need for better safeguards in some cases. Security arrangements regarding weapons of mass destruction need to be enhanced. The provisions relating to identify theft are inadequate, and powers to amend any provision without primary legislation should be repealed.
