Book excerpt: This volume offers a new theoretical approach to the analysis of the law/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book ("Vindicatory Justice: Conceptual Analyses and Forerunners") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part ("Mapping Vindicatory Justice") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.

It examines the “paradox of retribution”: the fact that we cannot seem to reject the intuition that punishment is morally required, and yet we cannot (even after two thousand years of philosophical debate) find a morally legitimate basis for inflicting harm on wrongdoers. The book comes at a time when a new “abolitionist” movement has arisen, a movement that argues that we should give up the search for justification and accept that punishment is morally unjustifiable and should be discontinued immediately. This book, however, proposes a new approach to the retributive theory of punishment, arguing that it should be understood in its traditional formulation that has been long forgotten or dismissed: that punishment is essentially a defense of the honor of the victim. Properly understood, this can give us the possibility of a legitimate moral justification for the institution of punishment.

Book excerpt: In this article I examine the legitimacy of allowing crime victims' desires for revenge to serve as a factor when imposing criminal punishment upon wrongdoers. I argue that revenge is in and of itself a value neutral emotion; an emotion which simply describes a victim's desire to get back at his victimizer. For example, if the victim wishes to mete out punishment upon a person who actually committed a criminal wrong upon him, such a desire for revenge, I suggest, is moral. Furthermore, if the punishment inflicted by the wronged party is proportional to the harm suffered, I argue that such a punishment represents a just resolution of the criminal matter. In other words, I disagree with the notion that revenge is, per se, immoral or unjust.My article then examines the historical and religious reasons why revenge justice was supplanted by State imposed justice, and concludes that it was not because of a belief in the inherent immorality of the desire for revenge, but rather, was due to the very practical concerns that revenge justice often punished the innocent, and permitted disproportionate and inequitable levels of punishment. Revenge justice also frequently created an endless and escalating level of violence which threatened, and in some cases, actually destroyed early civilizations.Based upon the above analyses, the article critically examines the traditional theories of Retribution and Utilitarianism as justifications for imposing criminal punishment, and concludes that both theories are deficient in that they fail to recognize and address the victim's interest in assuring just punishment. Similarly, the article also criticizes the notions that traditional tort remedies and restorative justice models, provide adequate venues for victim involvement and redress.The article thus concludes that victims' desires for revenge deserve to be recognized as a legitimate factor when deciding what the level of punishment should be, so long as the ultimate sentencing authority remains with the State. I then offer a number of procedural mechanisms which would enhance the level of victim participation at the sentencing phase of criminal justice proceedings, including granting victims party status at all proceedings where sentencing decisions are rendered.

Book excerpt: People often characterize revenge as unlawful and undesirable because it challenges the primacy of mercy, forgiveness, proportionality, and deterrence. Relying in part on the theories of Giorgio Agamben, Michel Foucault, Jacques Derrida, Carl Schmitt, and Walter Benjamin, I examine how nineteenth-century authors in the Americas treat revenge as a potentially law-making, law-preserving, and law-challenging form of violence. Specifically, the texts I analyze from the 1830s to 1850s employ the notion of exceptionalism to suggest that revenge is justified and even sometimes necessary for purportedly heroic protagonists when established law is in flux, is absent, or is unreliable--especially in borderlands or frontier spaces and during wartime. The authors have their individual protagonists rewrite law and act as sovereigns, blending biblical interpretations, natural law, lex talionis, and other beliefs to impose particular kinds of order on these exceptional locations and moments. In Chapter 1, I examine William Gilmore Simms's The Yemassee and how frontier romance authors generally depict Natives as vengeful, untrustworthy savages and whites as defenders of self and nation. In Chapter 2, I discuss how retellings of Hannah Duston's captivity and Robert Montgomery Bird's Nick of the Woods celebrate the acts of unlikely, feminized heroes as they kill and mutilate Native Americans. Chapter 3 focuses on the Parker captivities in Texas and George Lippard's 'Bel of Prairie Eden, wherein white, male Texans are depicted as defenders of white women's virtue and go on vengeful quests against the Comanche and Mexicans (respectively), ultimately exhibiting some ambivalence about whether revenge is fulfilling and justified. Finally, in Chapter 4 I analyze Maxwell Philip's Emmanuel Appadocca, the story of a black, Trinidadian pirate who challenges the rule of law and readers' ability to accept a mixed-race hero who uses his pirate ship and the space of the ocean to write revenge into law. This study informs scholarship on law and justice, race and gender, and American exceptionalism by linking literary studies to legal and political philosophy and considering revenge as a specific kind of violence that, when justified by individual authors and their protagonists, has had great effects on past and present politics.
