Book excerpt: This volume offers a new theoretical approach to the analysis of the law/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book ("Vindicatory Justice: Conceptual Analyses and Forerunners") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part ("Mapping Vindicatory Justice") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.

This book explores why a supposedly forgiving Christian culture should have relished such bloodthirsty, vengeful plays. A clue lies in the plays' passion for fairness, a preoccupation suggesting widespread resentment of systemic unfairness - legal, economic, political and social. Revengers' precise equivalents - the father of two beheaded sons obliges his enemy to eat her two sons' heads - are vigilante versions of Elizabethan law, where penalties suit the crimes: thieves' hands were cut off, scolds' tongues bridled. The revengers' language of 'paying' hints at the operation of revenge in the service of economic redress. Revenge makes contact with resistance theory, justifying overthrow of tyrants, and some revengers challenge the fundamental inequity of social class. Woodbridge demonstrates how, for all their sensationalism, their macabre comedy and outlandish gore, Renaissance revenge plays do some serious cultural work.

Confession and Criminal Justice in Late Medieval Italy sheds light on this contradiction through an in-depth comparison of lay and religious sources produced in Siena between 1260 and 1330 on criminal justice, conflict, and violence. Confession and Criminal Justice in Late Medieval Italy: argues that religious people were an effective pressure group with regards to criminal justice, thanks both to the literary works they produced and their direct intervention in political affairs, and that their contributions have not received the attention they deserve. It shows that the dichotomy between theories and practices of 'private' and of 'public' justice should be substituted by a framework in which three models, or discourses, of criminal justice are recognised as present in medieval Italian communes, with the addition of a specifically religious discourse based on penitential spirituality. Although the models of criminal justice were competing, they also influenced each other.

The country has achieved a successful transition to democracy and yet Indonesian democracy continues to be flawed, illiberal, and predatory. This book suggests that this and other paradoxes of democracy in Indonesia often assume occult forms in the Indonesian political imagination, and that the spirit-like character of democracy and corruption traverses into the national media and the political elite. Through a series of biographical accounts of political entrepreneurs, all of whom employ spirits in various, but always highly contested, ways, the book seeks to provide a portrait of Indonesia’s contradictory democracy, contending that the contradictions that haunt democracy in Indonesia also infect democracy globally. Exploring the intimate ways in which the world of politics and the world of spirits are entangled, it argues that Indonesia’s seemingly peculiar problems with democracy and spirits in fact reflect a set of contradictions within democracy itself. Engaging with recent attempts to look at contemporary politics through the lens of the occult, Democracy, Corruption and the Politics of Spirits in Contemporary Indonesia will be of interest to academics in the fields of Asian Studies, Anthropology and Political Science and relevant for the study of Indonesian politics and for debates about democracy in Asia and beyond.

Book excerpt: The South African Truth and Reconciliation Commission (TRC) was set up to deal with the human rights violations of apartheid during the years 1960-1994. However, as Wilson shows, the TRC's restorative justice approach to healing the nation did not always serve the needs of communities at a local level. Based on extended anthropological fieldwork, this book illustrates the impact of the TRC in urban African communities in Johannesburg. While a religious constituency largely embraced the commission's religious-redemptive language of reconciliation, Wilson argues that the TRC had little effect on popular ideas of justice as retribution. This provocative study deepens our understanding of post-apartheid South Africa and the use of human rights discourse. It ends on a call for more cautious and realistic expectations about what human rights institutions can achieve in democratizing countries.
