Book Restructuring the Gatt

Download or read book Restructuring the Gatt written by John H. Jackson and published by . This book was released on 1990 with total page 140 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The multilateral trading system based on the General Agreement on Tariffs and Trade (GATT) is being eroded by a shift to bilateralism, surging protectionism, and flouting of its rules by the major trading countries. The inclusion of the complex issues of services, intellectual property, and investment in the Uruguay Round has only increased the strain on the GATT's structure. Reform and strengthening of the GATT system can no longer be delayed. Jackson argues that part of the problem lies in the defective constitutional nature of the GATT itself. He examines the institutional and constitutional changes the GATT would need in order to contain protectionist pressure and respond to the new issues in the evolving international economy. Jackson outlines the provisions of a new charter that would strengthen the foundations of the system. His proposed reform challenges policymakers and practitioners to think beyond the modest objectives of the Uruguay Round"--Unedited summary from book cover.

Book The World Trading System

Download or read book The World Trading System written by John Howard Jackson and published by MIT Press. This book was released on 1997 with total page 464 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the first edition of The World Trading System was published in 1989, the Uruguay Round of trade negotiations has been completed, and most governments have ratified and are in the process of implementing the General Agreement on Tariffs and Trade (GATT). In the Uruguay Round, more than 120 nations negotiated for over eight years, to produce a document of some 26,000 pages. This new edition of The World Trading System takes account of these and other developments. Like the first edition, however, its treatment of topical issues is grounded in the fundamental legal, constitutional, institutional, and political realities that mold trade policy. Thus the book continues to serve as an introduction to the study of trade law and policy. Two basic premises of The World Trading System are that economic concerns are central to foreign affairs, and that national economies are growing more interdependent. The author presents the economic principles of international trade policy and then examines how they operate under real- world constraints. In particular, he examines the extremely elaborate system of rules that governs international economic relations. Until now, the bulk of international trade policy has addressed trade in goods; issues inadequately addressed by policy include trade in services, intellectual property rights, certain investment measures, and agriculture. The author highlights the tension between legal rules, designed to create predictability and stability, and the governments need to make exceptions to solve short-term problems. He also looks at weaknesses of international trade policy, especially as it applies to developing countries and economies in transition. He concludes with a look at issues that will shape international trade policy well into the twenty-first century.

Book World Trade Law after Neoliberalism

Download or read book World Trade Law after Neoliberalism written by Andrew Lang and published by OUP Oxford. This book was released on 2013-01-17 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: The rise of economic liberalism in the latter stages of the 20th century coincided with a fundamental transformation of international economic governance, especially through the law of the World Trade Organization. In this book, Andrew Lang provides a new account of this transformation, and considers its enduring implications for international law. Against the commonly-held idea that 'neoliberal' policy prescriptions were encoded into WTO law, Lang argues that the last decades of the 20th century saw a reinvention of the international trade regime, and a reconstitution of its internal structures of knowledge. In addition, the book explores the way that resistance to economic liberalism was expressed and articulated over the same period in other areas of international law, most prominently international human rights law. It considers the promise and limitations of this form of 'inter-regime' contestation, arguing that measures to ensure greater collaboration and cooperation between regimes may fail in their objectives if they are not accompanied by a simultaneous destabilization of each regime's structures of knowledge and characteristic features. With that in mind, the book contributes to a full and productive contestation of the nature and purpose of global economic governance.

Book An Institutional and Normative Analysis of the World Trade Organization

Download or read book An Institutional and Normative Analysis of the World Trade Organization written by Mary Footer and published by BRILL. This book was released on 2005-12-01 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book establishes a framework for analysis of the institutional and normative character of the WTO by locating the organization in a broader theory of international institutional law and in determining the basis for the conferral and exercise of powers in relation to its executive, legislative and adjudicative functions. The WTO is also read as an international regime in order to go beyond its formal legal and constitutional bases and to observe the Members’ practice in the context of the former semi-institutionalised GATT treaty regime with which it retains strong links. WTO decision-making, which underpins and informs its institutional and normative acts, is analysed in order to better understand the dynamics of the organization. Normative developments in the WTO are reviewed from the perspective of the creation, maintenance and revision of legally binding and non-binding or ‘soft’ law norms, in the sense of principles, rules and standards contained in primary treaty rules, which set out the rights and obligations of the Members, and subsidiary rule-making activity by WTO bodies.

Book The Globalization Paradox

Download or read book The Globalization Paradox written by Dani Rodrik and published by OUP Oxford. This book was released on 2012-05-17 with total page 442 pages. Available in PDF, EPUB and Kindle. Book excerpt: For a century, economists have driven forward the cause of globalization in financial institutions, labour markets, and trade. Yet there have been consistent warning signs that a global economy and free trade might not always be advantageous. Where are the pressure points? What could be done about them? Dani Rodrik examines the back-story from its seventeenth-century origins through the milestones of the gold standard, the Bretton Woods Agreement, and the Washington Consensus, to the present day. Although economic globalization has enabled unprecedented levels of prosperity in advanced countries and has been a boon to hundreds of millions of poor workers in China and elsewhere in Asia, it is a concept that rests on shaky pillars, he contends. Its long-term sustainability is not a given. The heart of Rodrik’s argument is a fundamental 'trilemma': that we cannot simultaneously pursue democracy, national self-determination, and economic globalization. Give too much power to governments, and you have protectionism. Give markets too much freedom, and you have an unstable world economy with little social and political support from those it is supposed to help. Rodrik argues for smart globalization, not maximum globalization.

Book Restructuring American Foreign Policy

Download or read book Restructuring American Foreign Policy written by John D. Steinbruner and published by Brookings Institution Press. This book was released on 2010-12-01 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the final days of this century, the United States will need to amend the core of its foreign policy—a formidable task in a large democracy. American thinking, still grounded in post-World War II perceptions, has failed to keep pace with the demands of a changing world. New realities in the U.S. and international economies, in security conditions, and in world politics call for restructuring American foreign policy. The policy experts contributing to this volume state the process of public debate that must precede the hard political choices ahead. Barry P. Bosworth and Robert Z. Lawrence consider the ramifications of an American economy no longer an implicit source of leverage in pursuing policy objectives. William W. Kaufmann prescribes ways to preserve international commitments and ensure American security in spite of fiscally constrained defense budgets. John D. Steinbruner discusses efforts to achieve a more stable military balance. In a related chapters, Kenneth Flamm and Thomas L. McNaugher propose a redraft of American investment patterns to make the defense technology more consistent with contemporary security requirements. All of this domestic restructuring will take place within the constraints and opportunities created by recent changes in China and the Soviet Union, continued economic expansion in Japan, and persistent unrest in the Middle East. Harry Harding and Ed A. Hewett review the prospects for reform in China and the Soviet Union. Harry Harding and Edward Lincoln describe the surge in many Asian economies and the increased importance of Japan as a world power. And in the final chapter, Harold H. Saunders turns attention to the Middle East, where identifying desirable solutions continues to be far easier than finding realistic methods for achieving them. The inauguration of a new administration creates an opportunity for political debate, a new conceptual focus, and effective political consensus. Restructuring American F

Book International Political Economy And Globalization

Download or read book International Political Economy And Globalization written by Javed Maswood and published by World Scientific Publishing Company. This book was released on 2000-09-05 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive introduction to international political economy and to the different trade and financial issues in the contemporary international system. The modern international political economy is characterized by globalization of production and finance. This book explains the growth and consequences of globalization from a historical and evolutionary perspective. It explores not only the long-standing issues of trade protectionism and financial stability, but also the newer issues of international labor standards, liberalization of investment regulations, and environmental protection. One of the greatest challenges of financial globalization is the potential for destabilizing national economies through a rapid outflow of capital, as seen recently in East Asia. In this book, the East Asian currency and debt crises are examined in relation to earlier crises in Latin America in the early 1980s and in Mexico in the mid-1990s. It will help readers to understand how politics and economics interact to produce the rules and structures of international political economy, and also to better appreciate the contemporary issues, crises, and challenges in international political economy.

Book The Political Economy of International Trade Law

Download or read book The Political Economy of International Trade Law written by Daniel L. M. Kennedy and published by Cambridge University Press. This book was released on 2002-05-23 with total page 712 pages. Available in PDF, EPUB and Kindle. Book excerpt: International experts from law, economics and political science provide in-depth analysis of international trade issues. Attorneys, economists and political scientists adopt a common viewpoint, entitled 'transcending the ostensible'. This approach directs particular attention to the possibility that WTO legal institutions, like other international legal institutions, will function in unexpected ways due to the political and economic conditions of the international environment in which they have been created, and in which they operate. A range of trade problems are considered here. Topics include the constitutional dimensions of international trade law, adding subjects and restructuring existing subjects to international trade law, the legal relations between developed and developing countries, and the operation of the WTO dispute settlement procedure. This will be an essential volume for professionals and academics involved with international trade policy.
