Book The Impact of Equity and Restitution in Commerce

Download or read book The Impact of Equity and Restitution in Commerce written by Peter Devonshire and published by Bloomsbury Publishing. This book was released on 2018-11-29 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: Commercial relationships give rise to diverse forms of legal obligation in private law, including contract, tort, agency, company law and partnership. More controversially, equity and the law of restitution have a less defined and somewhat ambulatory role in regulating the affairs of commercial parties. Nevertheless, their impact is manifest in the commercial arena through the distinct types of liability they engender and the remedies that are imposed. This collection draws together the views of leading international scholars and judges to explore the nature and extent of this impact from two perspectives. Five chapters primarily address this impact at a macro-level, focusing on the roles of equity and the law of restitution in terms of legal taxonomy, doctrine and policy. In contrast, five further chapters primarily address this impact at a micro-level, focusing on selected liabilities and remedies within equity and the law of restitution. This bifocal approach enables a holistic appreciation of some important ways in which equity and the law of restitution affect or may affect commerce, with a view to fostering further debate over the fundamental issues at stake.

Book The Principles of the Law of Restitution

Download or read book The Principles of the Law of Restitution written by Graham Virgo and published by Oxford University Press. This book was released on 2024-04-25 with total page 913 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fourth edition of The Principles of the Law of Restitution brings this widely cited and influential volume fully up to date. Substantially rewritten to reflect significant changes in the law of restitution and the expansion in the theoretical and critical commentary on the subject, this book is grounded in its clarity of exposition and analysis. The new edition significantly expands existing chapters on the treatment of the history of unjust enrichment, enrichment, the treatment of legally effective bases for receipt, and compulsion. It further expands existing parts on restitution for wrongs and proprietary restitutionary claims as well as offering completely new chapters dealing with 'at the claimant's expense', 'absence of intent', and the defence of illegality. Focusing primarily on English law, the volume also engages with the law in other common law jurisdictions, notably Australia, Canada, New Zealand, and Singapore. It provides a clear exposition of complex areas of law as well as critical analysis of that law. Timely and comprehensive, this book provides readers with a crucial guide to the law of restitution and will continue to be invaluable to student, academics, and practitioners alike.

Download or read book Problems in Remedies written by Dan B. Dobbs and published by West Academic Publishing. This book was released on 1993 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The problems embodied in this book differ from the usual academic presentation in several ways. First, students are not initially confronted with an authoritative statement of "law" but with facts and human problems. Second, except in the four introductory chapters, the problems are not organized to present an orderly sequence of remedies rules. Instead, they are organized around diverse factual settings, so the issues come to the student just as they come to lawyers in practice-helter-skelter. Requires students to work analytically, not in an organization dictated by the logic of a casebook.

Book excerpt: This new edition of Unjust Enrichment by the editor of the Clarendon Law Series, is a fully updated, clear and concise account of the law of unjust enrichment. It attempts to move away from the use of obscure terminology inherited from the past. This text is the first book to insist on the switch from restitution to unjust enrichment, from response to event. It organises modern law around five simple questions: Was the defendant enriched? If so, was it at the claimant's expense? If so, was it unjust? The fourth question is then what kind of right the claimant has, and the fifth is whether the defendant has any defences. This second edition was revised and updated by Peter Birks before his death from cancer on 6 July 2004 at the age of 62. It represents the final thinking of the world's leading authority on the subject.
