Book excerpt: Situations of serious or massive violations of human rights are no longer purely of domestic concern, and sovereignty can no longer be an absolute shield for repressive governments in such circumstances. Based on this realization, the international community has recognized a responsibility to protect individuals in states where their governments are unable or unwilling to provide protection against the most serious violations. However, so far, only one intergovernmental organization, the African Union (AU), has explicitly made the right to intervene in a Member State part of its foundational text in Article 4(h) of its Constitutive Act. Although there have been cases of Article 4(h)-type interventions in Africa, the AU Assembly has not yet invoked Article 4(h) explicitly. This book brings together experts in the field to explore the potential application of Article 4(h), and the complexities that may explain its non-invocation so far. Although Article 4(h) is noble in purpose, its implementation faces several legal and policy challenges given that the use of force penetrates the principles of state sovereignty and non-intervention – the very cornerstones upon which the AU is founded. This book considers these issues, as well as the need to reconcile Article 4(h), in so far as it allows the AU to exercise military intervention to protect populations at risk of mass atrocities, with the provisions of the Charter of the United Nations. Drawing from the insights of law, political science, diplomacy and military strategy, the book offers a unique combination of multi-disciplinary expertise that harnesses the views of a diverse group of authors, focused on the legal, policy, and practical insights on the implementation of Article 4(h) and the responsibility to protect in Africa in order to provide concrete recommendations on how to end mass atrocities on the continent

Mine closure presents a major challenge to the mining industry and government policymakers globally, but particularly in the Global South. South Africa is experiencing notable numbers of mine closures, and this book explores the notion of social disruption, a concept often applied to describe the effects of mine growth on communities but often neglecting the impact of mine closures. The book begins with three theoretical chapters that discuss theory, closure cost frameworks and policy development in South Africa. It uses evolutionary governance theory to show how mining creates dependencies and how mining growth often blinds communities and governments to the likelihood of closure. Too easily, mining goes ahead with no concern for the possibility, or indeed inevitability, of eventual closure and how mining communities will cope. These impacts are showcased through eight place-based case studies from across South Africa, one focusing on mine workers, to demonstrate that mine closure causes significant social disruption. Book excerpt: For three decades post-apartheid, the HIV/AIDS epidemic from first acknowledgement to its management as a chronic disease, demanded unparalleled attention. This was nowhere more evident than in South Africa. This book explores how the state responded to its responsibilities to defend and protect (human) security. Linking this to the role of the state as sovereign protector and provider of security, it applies the findings to the broader re-interpretation of sovereign responsibility in the 21st Century. This book does not seek to absolve the South African state of its responsibility to respond. Moreover, it argues that although the state, the government, before, during, and after the transition to democracy, was aware of and acknowledged the threat - political, economic and social - posed by the epidemic, it nonetheless chose not to make the epidemic a priority policy issue. As a result, it argues that the South African HIV/AIDS case illustrates the tension inherent between a state’s ultimate sovereign responsibility to respond and its tactical dependence on external contributors to meet the demands of all of its constituents.
