Book Honour Based Crimes and the Law

Download or read book Honour Based Crimes and the Law written by Mukaddes Gorar and published by Routledge. This book was released on 2021-05-10 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Honour based violence and abuse manifests itself in different forms, and this book offers a comprehensive understanding of this phenomenon. This book argues that the limits of honour crimes must be defined more widely so that they include conducts and behaviours that originate from the patriarchal notion of honour, such as honour based oppression and breast ironing. The book provides a critical analysis and synthesis of the law in England and Wales and in the international human rights sphere. The relevant domestic legislation and cases are examined to reflect on whether adequate protection is provided for the victims and potential victims of honour based violence and abuse. Since honour based violence is a violation of human rights, the relevant international human rights law is examined to illustrate the perception of such crimes in the international arena. The effectiveness of any remedy for victims of honour based violence and abuse depends on its capability to change deep rooted behaviours in communities with honour based patriarchal values. This book argues that the law does not provide the effective impact required, in part due to patriarchal structures, and that more efforts should be dedicated to changes in education. It is held that there is a need for an educational programme that is especially designed to tackle violence and promote gender equality. The book will be essential reading for academics, researchers and policy-makers working in the areas of Human Rights Law, Criminal Law and Gender Studies.

Book Witchcraft Accusations and Persecutions as a Mechanism for the Marginalisation of Women

Download or read book Witchcraft Accusations and Persecutions as a Mechanism for the Marginalisation of Women written by Samantha Spence and published by Cambridge Scholars Publishing. This book was released on 2017-08-21 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: This books draws on feminist commentary from the disciplines of anthropology, history, law, politics and sociology in order to deal with the phenomenon of modern-day witchcraft. It focuses on the re-emergence of witchcraft beliefs in contemporary society, suggesting that witchcraft accusations and persecution are being used as a marginalisation mechanism of women. The re-emergence of witchcraft beliefs in contemporary society and the prevalence of the violence associated with such beliefs has received little attention within academic literature, yet witchcraft-related violence against women is, progressively, becoming one of the most pervasive forms of violence facing women today. This book addresses this gap in the literature, discussing the return of witchcraft beliefs to contemporary society, whilst assessing the effectiveness of international human rights law in protecting women from witchcraft accusations and persecution.

Book Women Islam and International Law

Download or read book Women Islam and International Law written by Ekaterina Yahyaoui Krivenko and published by BRILL. This book was released on 2009 with total page 281 pages. Available in PDF, EPUB and Kindle. Book excerpt: Islam and womena (TM)s human rights entertain an uneasy relationship. Much has been written on the subject. This volume addresses it from a new perspective. It attempts to define some basis for constructive dialogue and interaction in the context of international law and, more precisely, in the context of participation of many Muslim States in the United Nations Convention on the Elimination of All Forms of Discrimination Against Women. Having discovered a constructive potential in both Islam and womena (TM)s human rights, the author concentrates on the role which international law should play in promoting dialogue and constructive interaction. This is done mainly through analysis of the regime of reservations and of the practice of reservations developed in the context of Muslim Statesa (TM) participation in the CEDAW. The basic thesis defended is the following: Islam as articulated in the practice of States and womena (TM)s human rights, as reflected in international instruments, are both results of human activity. Their analysis in this study reveals more commonalities than one might expect. International law should be more attentive to their voices and more innovative in using these commonalities in order to promote constructive dialogue between them and thus help to improve the situation of women suffering from discrimination and inequalities.

Book Women and Equality in Iran

Download or read book Women and Equality in Iran written by Leila Alikarami and published by Bloomsbury Publishing. This book was released on 2019-05-30 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Iran's continued retention of discriminatory laws stands in stark contrast to the advances Iranian women have made in other spheres since the Revolution in 1979. Leila Alikarami here aims to determine the extent to which the actions of women's rights activists have led to a significant change in their legal status. She argues that while Iranian women have not yet obtained legal equality, the gender bias of the Iranian legal system has been successfully challenged and has lost its legitimacy. More pertinently, the social context has become more prepared to accommodate legal rights for women. Highlighting the key challenges that proponents of gender equality face in the Muslim context, Alikarami attempts to ascertain the causes of Iran's failure to ratify the CEDAW and questions whether and to what extent interpretations of Islamic principles prevent Iran from doing so. Applying feminist legal theory to contemporary Iran, Alikarami's approach re-evaluates the underlying principles that have shaped the struggle for equal rights between the sexes.

Download or read book Women s Property Rights Under CEDAW written by José E. Alvarez and published by Oxford University Press. This book was released on 2024 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: For over 40 years, the leading international treaty body on women's rights, the Committee on the Elimination of All Forms of Discrimination Against Women (the CEDAW Committee), has been generating jurisprudence interpreting CEDAW's obligations that states protect the equal rights of women. This book concludes that CEDAW's re-engendering of property--although a flawed and evolving work in progress--has the potential to be transformative for the half of the planet who is more likely to be treated as property than to have any.

Available in PDF, EPUB and Kindle. Book excerpt: Is there a basis for human rights in Islam? Beginning with an exploration of what rights are and how the human rights discourse developed, Abdullah Saeed explores the resources that exist within Islamic tradition. He looks at those that are compatible with international human rights law and can be garnered to promote and protect human rights in Muslim-majority states. A number of rights are given specific focus, including the rights of women and children, freedom of expression and religion, as well as jihad and the laws of war. Human Rights and Islam emphasises the need for Muslims to rethink problematic areas of Islamic thought that are difficult to reconcile with contemporary conceptions of human rights.

Book Reservations to Human Rights Treaties and the Vienna Convention Regime

Download or read book Reservations to Human Rights Treaties and the Vienna Convention Regime written by Ineta Ziemele and published by Springer. This book was released on 2013-11-09 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: There has always been some discomfort about reservations in relation to international obligations of States applicable to individuals. This apprehension was once again brought to the forefront of the international normative process with General Comment No. 24 of the Human Rights Committee and the work of the International Law Commission on reservations to treaties. This book is a contribution to the debate on reservations to human rights treaties. Several key questions are addressed. Can the reservations' regime, as codified in the 1969 Vienna Convention on the Law of Treaties, adequately address human rights relationships? Is there a danger of further fragmentation of international law if human rights treaties were to be treated differently as concerns the reservations'regime applicable to these treaties? Should the distinction be made between the validity of a reservation and the effects of a reservation found to be invalid? These and other questions continue to generate a variety of answers.

Book The Globalization of Motherhood

Download or read book The Globalization of Motherhood written by Wendy Chavkin and published by Routledge. This book was released on 2010-09-13 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: The convergence of dramatic declines in birth rates worldwide, aside from sub-Saharan Africa, the rise of untrammelled global movement of capital, people and information, and the rapid-fire dissemination of a host of new medical technologies has led to the "globalization of motherhood". This book brings together research from the Global North and the Global South to illuminate how contemporary motherhood is being changed by the processes of globalization. It locates declining fertility and desire for motherhood in the context of female employment, the development of the global market in reproductive technologies, the rising transnational labour market demand for feminized carework, and changing family forms. Focusing on the impacts on women who mother- and enable others to do so- across diverse contexts, the book examines the way in which conception, gestation mothering labor and care are being mobilized across national boundaries. Bringing together demographers, sociologists, lawyers, public health and social theorists, this book will be of interest to students and scholars of globalization studies, development studies, gender studies, feminist politics, political economy, human rights, and social policy.
