Cette montée est bien réelle en matière de délits non intentionnels. De nombreux secteurs sont touchés : établissements recevant du public, activités sportives et ludiques, secteur scolaire, voirie publique, environnement et commande publique. S'il est vrai que de nombreuses explications peuvent être avancées (droit des victimes, foisonnement des textes et des normes, intégration communautaire), les élus doivent savoir qu'aujourd'hui les exigences en matière de sécurité s'appliquent dans le secteur public comme dans les activités privées. Cette progression des responsabilités est cependant mal comprise par les élus qui ont le sentiment de travailler pour l'intérêt général avec des faibles moyens humains et financiers. La méconnaissance des pouvoirs du maire et des fondements du droit pénal entraîne une incompréhension majeure : ce n'est plus souvent une action pénale mais l'imprudence ou la négligence. Certains délits intentionnels se réalisent sans même une intention frauduleuse. Enfin, cette montée des responsabilités ne doit pas être vécue comme un drame. Quand la peur du juge sera vaincue, c'est que les élus auront fait l'apprentissage de leurs responsabilités. C'est aussi l'occasion de repenser l'organisation et le fonctionnement des petites collectivités territoriales et d'expliquer le principe de précaution dans toutes les activités locales.

Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.
