Book Resisting United Nations Security Council Resolutions

Download or read book Resisting United Nations Security Council Resolutions written by Sufyan Droubi and published by Routledge. This book was released on 2014-04-24 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Security Council has primary responsibility for maintaining international peace and security. In discharging its powers it must act in accordance with the Purposes and Principles of the UN, and observe the rules governing voting and procedure established in the Organisation’s Charter. The Council adopts mandatory resolutions that may establish obligations for members and non-members, and such obligations trump conflicting obligations originating from any other international agreement. Member States must cooperate with the Organisation and among themselves, in the implementation of any action prescribed by the Council against States whose behaviour the Council considers an act of aggression, or a threat to, or breach of, international peace and security. This book analyses resistance to Security Council resolutions and puts forward a theory of lawful resistance. Sufyan Droubi takes a positivist approach to the UN Charter regarding it as a constitution. Special emphasis is placed on the construction of the Charter’s meaning through the practice of both organs and Members of the UN and on the need to enhance the effectiveness of the Organization with due respect to the rule of law. The book proposes that nonviolent resistance to a mandatory resolution of the Security Council, on grounds that the latter is incompatible with the Charter or jus cogens norms, may be considered lawful under the Charter if some elements are present. In exploring a number of case studies of individual and collective State resistance to mandatory Council resolutions, the book proposes that resistance may function as a rudimentary instrument of accountability and protection of the Charter and jus cogens, in the absence of more mature mechanisms of judicial review. The book will be of excellent use and interest to scholars and students of constitutional international law and international relations.

Book The UN Security Council

Download or read book The UN Security Council written by David Malone and published by Lynne Rienner Publishers. This book was released on 2004 with total page 764 pages. Available in PDF, EPUB and Kindle. Book excerpt: The nature and scope of UN Security Council decisions - significantly changed in the post-Cold War era - have enormous implications for the conduct of foreign policy. The UN Security Council offers a comprehensive view of the council both internally and as a key player in world politics. Focusing on the evolution of the council's treatment of key issues, the authors discuss new concerns that must be accommodated in the decisionmaking process, the challenges of enforcement, and shifting personal and institutional factors. Case studies complement the rich thematic chapters. The book sheds much-needed light on the central events and trends of the past decade and their critical importance for the future role of the council and the UN in the sphere of international security.

Book excerpt: In contrast to the common perception that the United Nations is, or should become, a system of collective security, this paper advances the proposition that the UN Security Council embodies a necessarily selective approach. Analysis of its record since 1945 suggests that the Council cannot address all security threats effectively. The reasons for this include not only the veto power of the five permanent members, but also the selectivity of all UN member states: their unwillingness to provide forces for peacekeeping or other purposes except on a case-by-case basis, and their reluctance to involve the Council in certain conflicts to which they are parties, or which they perceive as distant, complex and resistant to outside involvement. The Council’s selectivity is generally seen as a problem, even a threat to its legitimacy. Yet selectivity, which is rooted in prudence and in the UN Charter itself, has some virtues. Acknowledging the necessary limitations within which the Security Council operates, this paper evaluates the Council’s achievements in tackling the problem of war since 1945. In doing so, it sheds light on the division of labour among the Council, regional security bodies and states, and offers a pioneering contribution to public and governmental understanding of the UN’s past, present and future roles.

Download or read book To Keep the Peace written by William W. Orbach and published by University Press of Kentucky. This book was released on 2021-09-15 with total page 179 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first purpose of the United Nations is "to maintain international peace and security." Among the chief methods employed to attain this end has been the condemnatory resolution, in which international outrage is expressed at the policies or actions of a given state. Here William W. Orbach undertakes to explore the nature of the United Nations and its role in international politics through an examination of the history of such resolutions, the reasons for condemnations, and the process by which they are enacted or rejected. He concludes that the United Nations is not an independent actor on the international stage but a microcosm of that stage, as such in a unique position to further international peace.

Book Understanding the UN Security Council

Download or read book Understanding the UN Security Council written by Neil Fenton and published by Ashgate Publishing, Ltd.. This book was released on 2004 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This impressive work sheds light on the recent history of the UN Security Council (UNSC), examining how the penchant for UN-backed humanitarian intervention in the 1990s has given way to an impotent UNSC, unable to play a meaningful role in the war in Iraq. The book is designed for readers who are interested in gaining a deeper understanding of the workings of the UNSC and the attitudes of its members towards the use of force and sovereignty, as well as understanding its limitations in international politics.
