Download or read book Legal Whores written by Thomas A. Binford and published by Trafford Publishing. This book was released on 2002 with total page 220 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a synopsis of the legal industry & basic "how to" for the individual that can’t afford an attorney. The "how to" advice is directed to the more mundane everyday type litigation w/c might confront a person on a daily basis. Forms & advice might vary a little with the specific jurisdiction & timely publishing of this manual but the premise & foundation remain the same. As a whole, attorneys, lawyers, or judges are known by the connotation of LEGAL WHORES in this book. It is a deservedly appropriate title for this vocation. Before proceeding, please be advised that these are real, non-fiction accounts of what the legal fraternity does to extract money from the public. There literally are no limits/bounds as to what the judicial fraternity will do to acquire wealth in whatever form. Two of the main attributes used to extract money from his clients are the client's greed/emotions. The lawyer tells his client that they will win the case & the client will probably get a zillion dollars. The typical person in these United States, salivates at the prospect of getting unearned moneys from the sweat of someone else. This is easy prey for the attorney. Then there is the emotional scenario where the client is involved in a situation that incurs his emotional wrath/confrontational issues involving neighbors, family, business. The attorney convinces his client that he can get the best of the opposition in court, therefore, let's get 'em! Whether the merits of the case warrant litigation/not is purely incidental to the attorney's desire to line his pockets with the client's cash. Most litigation requires little cost to the litigant for resolution via mediation, arbitration/limited litigation. However, this sort of resolution puts little money in the pockets of the legal fraternity. Use psychology & prey on the client's greed &/or emotional behavioral attributes to extract the maximum amount of fees from the clients for the attorney's efforts-as defined by the attorney

Book Contractual Performance and COVID 19

Download or read book Contractual Performance and COVID 19 written by Franz Schwarz and published by Kluwer Law International B.V.. This book was released on 2021-11-25 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the COVID-19 pandemic continues to take its toll, contractual parties have frequently faced significant obstacles in performing their contractual obligations due to unexpected impediments arising from the pandemic and government measures taken in response. This indispensable book – the most comprehensive comparative examination of the impact of the COVID-19 pandemic on contractual performance – discusses the legal provisions and doctrines available to address these issues. The book examines under what circumstances COVID-19-related impediments may excuse contractual performance or lead to modification or termination of the affected contractual obligations in twelve representative civil and common law jurisdictions – the United States, England and Wales, Singapore, Brazil, Germany, France, Switzerland, Austria, Hong Kong, Costa Rica, China, and Russia. For each country, the book examines the following aspects in depth: the relevant fundamental legal principles; the various legal emergency valves available to an obligor to respond to COVID-19-related events; any remedies available to the obligee; selected examples for specific government measures related to particular types of contracts (e.g., construction, employment, lease agreements); and how the legal framework applies in typical factual scenarios. As further legal and factual developments occur, and with further jurisdictions being added, this publication will continue to be updated both online and in print. The book provides a detailed explanation under what conditions the emergency valves specific to each jurisdiction may apply. It cuts through the seeming complexity of the various legal rules and doctrines in these jurisdictions and shows that they often produce similar results in practice. The book thus opens up a wealth of insights for businesses, practitioners, and academics around the globe by providing an easily accessible analytical framework across key jurisdictions and typical factual scenarios. ‘Definitely mandatory reading for practitioners and academics alike!’ –Klaus Peter Berger, University of Cologne ‘Everyone who has had or is likely to have a brush with a COVID-19-induced legal issue would be well advised to keep this book within arm’s reach.’ – Davinder Singh, Davinder Singh Chambers LLC, Singapore ‘The “holy book” for all those lawyers whose clients become ensnared in the rising attempts to fix legal liability midst the rampant COVID-19.’ – Charles Brower, Twenty Essex, London

Book In Defense of Housing

Download or read book In Defense of Housing written by Peter Marcuse and published by Verso Books. This book was released on 2024-08-27 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: In every major city in the world there is a housing crisis. How did this happen and what can we do about it? Everyone needs and deserves housing. But today our homes are being transformed into commodities, making the inequalities of the city ever more acute. Profit has become more important than social need. The poor are forced to pay more for worse housing. Communities are faced with the violence of displacement and gentrification. And the benefits of decent housing are only available for those who can afford it. In Defense of Housing is the definitive statement on this crisis from leading urban planner Peter Marcuse and sociologist David Madden. They look at the causes and consequences of the housing problem and detail the need for progressive alternatives. The housing crisis cannot be solved by minor policy shifts, they argue. Rather, the housing crisis has deep political and economic roots—and therefore requires a radical response.

Book The Idea of Home in Law

Download or read book The Idea of Home in Law written by Dr Lorna Fox O'Mahony and published by Ashgate Publishing, Ltd.. This book was released on 2013-02-28 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Idea of Home in Law: Displacement and Dispossession explores an important set of legal and policy issues surrounding the concepts of home and homelessness, taking a growing area of legal scholarship into the new arena of human rights and international law. The collection considers the ideas concerning home - both in the sense of the dwelling place as a special type of property, and territorial claims to homeland - which underpin many contemporary legal problems, by examining a range of contexts where people are displaced or dispossessed from their homes. The essays focusing on dispossession consider themes ranging from mortgage and rent arrears in the UK to responses to the foreclosure crisis in the USA, and from eviction for the purposes of economic development in South Africa to the exclusion of asylum seekers from the UK's social housing and welfare provision, and within the framework of the European Convention on Human Rights. The displacement theme, meanwhile, examines transnational 'home' issues from the experiences of exiles and refugees in areas of conflict to the impact of the broader context of economic, social and cultural rights on attempts to protect housing and home through international law. At the heart of each essay the contributors, experts from across the fields of law, policy, and housing rights, examine the circumstances in which displacement and dispossession take place, and reconsider how law and policy respond to such circumstances with a particular focus on the impact of loss of home for the human person. At a time of particular and increasing concern about security of tenure and the role of law and policy in protecting people who are vulnerable to forced eviction, The Idea of Home in Law presents a bold opportunity to raise questions about the 'rights' and norms associated with housing and home, and to generate new insights for scholarship and for national and international policy debates concerning displacement and dispossession.
